Like Siddartha, I am being harassed, says Mallya

Runaway businessman Vijaya Mallya has made sensational statements against banks and government agencies in the wake of the suicide of Cafe Coffee Day founder VG Siddhartha. Mallya, who is hiding in London, tweeted a message saying that like Siddhartha, he is also being harassed. He said that the Siddhartha story is the example of how banks can drive anybody to despair. This clearly shows how businessmen are being treated in the country.

Mallya deplored that he has come forward to dispose of his property to clear all the debts but the government agencies and banks are not supporting him. In Western countries, they give all help necessary to a businessman to enable him to repay debts. Mallya’s tweet created a sensation in political and business and corporate circles across Indian and abroad. He has been accused of defaulting huge loans worth Rs. 9,000 crore in India.

Mallya has got some previous association with Siddhartha who is known as the King of Coffee. Saying that Siddhartha is an excellent human being, Mallya said that his letter written prior to his extreme step had devastated him. Mallya said that the government agencies are also vicious and unrelenting although he is promising to make full repayment.

Congress, BJP attack each other over Mallya; Rahul seeks Jaitley’s resignation

0

A fresh war of words broke out between the BJP and Congress over Vijay Mallya on Thursday with Congress President Rahul Gandhi seeking Finance Minister Arun Jaitleys resignation over “free passage” given to the fugitive businessman and the BJP hitting out by alleging that UPA government gave “sweet deals” to him and that Gandhi family “partially owned the now-defunct Kingfisher Airlines through proxy”.

The ruling party rejected the demand for Jailtley’s resignation and instead sought to turn the tables on Congress by asking Rahul Gandhi to quit in view of his involvement in National Herald case.

The day saw two press conferences each by the Congress and BJP with Gandhi coming to party’s central office to attack Jaitley.

It came a day after Mallya said he had met Jaitley and the Union minister rubbished the claim of any formal meeting.

Gandhi accused Jaitely of “colluding” with Mallya who is facing charges of fraud and money laundering amounting to around Rs 9,000 crore.

He asked why Jaitley did not inform the investigating agencies about Mallya’s plans to leave India.

“There is a clear-cut collusion. He (Jaitley) should have confessed (about the meeting) and he should resign. The Finance Minister talks to an absconder (Mallya) and the absconder tells the Finance Minister that I am going to London. The Finance Minister neither told the CBI, the ED or the police, why?

“He was given a free passage to leave the country by the Finance Minister. There was a lookout notice against Mallya which was diluted to an inform notice. Who changed it? This can be done only by one who controls the CBI,” he alleged.

Gandhi also demanded to know if the decision was taken by Jaitley himself or the “order came from the top”.

“The Finance Minister has colluded with a criminal running away from the country. He was told by the criminal that he is going to run away but the Finance Minister did nothing. The government is lying on Rafale, they are lying on Mallya”.

At the media conference, Congress MP P.L. Punia claimed to give an eyewitness account of the meeting between Jaitley and Mallya in the Central Hall of Parliament before the businessman fled the country on March 2, 2016.

Punia claimed the meeting between Jaitley and Mallya lasted 15-20 minutes and asked if Mallya had taken permission from Jaitley about his planned flight abroad.

Hitting out at the Congress, BJP spokesperson Sambit Patra alleged that there were documents that show how RBI and UPA under Sonia Gandhi and Manmohan Singh had given sweet deals to Kingfisher Airlines.

“And it appears through these chain of documents that Kingfisher Airlines was owned not by Mallya but by the Gandhi family through proxy,” he alleged showing the letters written by RBI to SBI requesting for the restructuring of the loans of Kingfisher Airline

The accuracy of the documents could not be ascertained. There was no immediate response from Rahul Gandhi’s office.

Patra also alleged that the party has enough evidence which shows that Rahul Gandhi was “using black money” and the Gandhi family was helping Mallya with sweet deals.

He claimed that Rahul Gandhi travelled free in Kingfisher Airlines, which was once owned by Mallya.

“Rahul Gandhi took one crore loan from a shell company, we have the confession of the company director,” Patra alleged.

At another press conference, Congress Communications In-charge Randeep Singh Surjewala posed specific questions to the Modi government.

“Why was no action taken against Vijay Mallya for bank fraud despite registration of an FIR by CBI on July 29, 2015? Who asked CBI to change its look-out notice of October 16, 2015 into a mere ‘inform notice’ on November 23, 2015? Who directed the banks to delay filing of the case in the Supreme Court,” he asked.

Earlier in the day, Union Law Minister Ravi Shankar Prasad told reporters that all the allegations against Jaitley were “false”.

“All these remarks are being made after Rahul Gandhi’s London visit. Is there anything common between them (Mallya and Rahul Gandhi)?” he asked.

Railways Minister Piyush Goyal, who addressed a press conference at the BJP headquarters, said Rahul Gandhi was “facing serious criminal charges” and that he “should first resign.”

“Those who took loans from hawala companies and accumulated wealth by taking government land free of cost or at lower rate from National Herald and whose case was rejected by Delhi High Court, should resign first,” he said.

He also dismissed the claims of Punia about Mallya meeting Jaitley in the Central Hall of Parliament.

However, he left to UK without paying bank debts and Government of India’s plans of extradition didn’t work out yet. I have not diverted any money to IPL: Mallya

0

Fugitive liquor baron Vijay Mallya, whom India wants extradited for facing trial in a Rs 9,000-crore bank loan default case, on Tuesday claimed that he has not diverted any of the borrowed money to the team he owned in the IPL and asked reporters to “keep dreaming about the billions of pounds” that he had allegedly diverted.

Mallya, whose bail was continued till December 4, appeared before a Westminster magistrate court on Tuesday and later told media outside that he was delighted that he would be able to put up his case before a “fair and impartial” court here.

Accompanied by his son Siddharth, the 61-year old industrialist who fled India 15 months ago rejected all allegations of default of loans against him and denied he was called a thief by some spectators during a Champions Trophy match at the Oval grounds here.

“I am not going to answer any questions. There is a court of law. We will make submissions before the appropriate court of law,” he told reporters.

“You can keep dreaming about billions of pounds, provided you have facts to justify your questions. Otherwise, don’t put questions. Don’t ask irrelevant questions,” he said, when asked whether he had diverted the borrowed money to IPL team Royal Challengers, which he used to own.

This was the first hearing before a magistrate in what is called “management” proceedings before the actual trial begins. Mallya was asked to sit in the place where people facing trial are made to sit. His name was called out and his date of birth mentioned by way of confirming his identity.

Mallya, who owes as much as Rs 9,000 crore to a consortium of Indian banks, fled to Britain in March last year. India is seeking his extradition for which the procedure has already begun and a team of the Enforcement Directorate and the Central Bureau of Investigation is chalking out the process.

When he sought a barrier to keep away inquisitive television reporters from thrusting their mikes before him outside the court, the judge permitted that he may not be present at the next hearing on July 6.

During the proceedings, Mallya’s lawyers told the magistrate that the Indian government was coming up with a second extradition request which he would like to go through before giving his submissions. They wanted that the case be deferred till next year. Magistrate Emma Louis Arbuthnot, however, indicated that the case could be placed for regular trial in December.

When the magistrate enquired with the Crown Prosecution Service about cooperation from India, he was told that there was good cooperation and coordination between the two sides.

Outside the court, the chairman of the now-defunct Kingfisher Airlines by and large remained composed while answering media questions except when reporters tried to provoke him a couple of times.

When a British reporter asked him about the multiple flats he has in here, he shot back: “Multiple homes in UK – I have been living here since 1992.”

Mallya said he was here to defend himself as was expected.

“Were you in the court? Did you hear what the prosecution said, what my lawyers said and what the judge said?” he asked, refusing to go into what happened inside the court.

But when a reporter asked him about the “chor, chor” (thief) chants hurled at him during an India-South Africa match last week, Mallya said: “I was not called a thief. As two people in a drunken state yelled at me, didn’t you notice that there were several others who wished me well.”

He remarked that when he went to cheer the Indian cricket team in the Champions Trophy, it “became a media sensation”. “I go to cheer India in a cricket match and it becomes a media frenzy. It’s better I don’t say anything.”

Asked if he was relieved at being told by the court not to come for the next hearing on July 6, he said: “I do not want to say anything about what happened inside the court.

“I am delighted that I can put forward my case before an impartial court,” he said.

Earlier before going into the court, Mallya said he had not eluded any court of law and denied all allegations levelled against him.

When a questioner noted that he has been in Britain for the last 15 months and was eluding courts in India, he said: “I have not eluded any court. It is my lawful duty to be here and I am here (London court).”

“I have nothing to say as the court proceedings are on and I deny all allegations that have been made and I will continue to deny them,” he said.

Mallya also said he had “enough evidence” to fight the case, but parried a question whether he fears that a trial in India would be unfair to him.

Mallya’s extradition not easy: Legal experts

It would not be easy to extradite controversial industrialist Vijay Mallya, who went to the UK a year ago and did not return despite summons to him by the courts here for defaulting on loans, legal experts today said.

Senior advocates K T S Tulsi and Dushyant Dave were of the view that the courts in the UK are very independent and do not grant extradition easily.

Tulsi said that though the Indian government has sent the evidence against Mallya to the UK courts while requesting his extradition, the courts there will “evaluate it independently to see if the evidence is sufficient” to send him back here.

He also said that Mallya’s arrest today by Scotland Yard and his subsequent release on bail the same day shows it may not be easy to get him back here.

Tulsi said when there is a request for extradition then normally bail is granted only after 60 days, but Mallya was given the relief on the same day.

He also said that in the past 50 requests for extradition sent to the UK, the courts there have granted only one.

Dave was also of a similar view as he said that courts there are independent and “do not grant extradition so easily”.

He, however, refused to comment further on it saying he was not fully versed with the procedure followed by the courts there.

This reason was cited by several other senior lawyers who wished not to be named.

Mallya, who has been declared a proclaimed offender in India, was arrested in London by the Scotland Yard on India’s request for his extradition on fraud charges.

The 61-year-old liquor baron, wanted in India for defaulting on loans, was arrested after he appeared at a central London police station this morning.

The flamboyant businessman, who once called himself ‘The King of Good Times”, was released on bail a few hours later.

Vijay Mallya arrested in London, gets bail

Liquor baron Vijay Mallya, wanted in India for defaulting on over Rs 8,000 crore in bank loans, was arrested here on Tuesday. Within hours, a court granted him bail.

Metropolitan Police said Mallya, 61, was taken into custody after attending a central London police station.

The Westminster Magistrates’ Court later gave him bail on a 650,000 pound bond. The next hearing of the case will be on May 17.

A Metropolitan Police statement said officers from the Extradition Unit arrested Mallya on an extradition warrant from India.

“Mallya was arrested on behalf of the Indian authorities in relation to accusations of fraud,” the statement said.

After getting bail, Mallya tweeted: “Usual Indian media hype. Extradition hearing in court started today as expected.”

Mallya fled to Britain in March 2016 after being pursued in courts by Indian banks seeking to recover Rs 8,191 crore owed by his now defunct Kingfisher Airline.

The banks had been able to recover only Rs 155 crore. Despite multiple injunctions, Mallya failed to appear before investigators — and then flew out of India.

In February, the Indian government handed over to the UK authorities a formal request for Mallya’s extradition, saying it had a legitimate case against him on charges of financial irregularities and loan default.
