H1/OPT students detained,deported at ORD airport

O’hare Chicago airport is a popular port of entry for a number of H1b and F1b visa holders. A recent experience of a H1B visa holder who was deported on sep 26th at ORD airport, is below.

We urge our readers not to misrepresent anything to immigration authorities and comply with the laws in every possible way to minimize these type of issues.

This person’s H1B visa was cancelled, he was deported back to India primarily for having misrepresenting his work experience to the clients and for possessing multiple versions of resumes in his cellphone’s Inbox.

While inspecting your iphone I found numerous resumes in your e-mail with different work experience listed.why is this?
A. (No Response)

Why do you have multiple Resumes with different work applications?
A. I have not submitted it

According to Your cell phone you have submitted these resumes multiple times. why are you saying you didn’t?
A.(No Response)

How Long have you Worked in the united states?
A.I been with OPT and this client

So lets say from October of 2015?
A.Yeah

According to this resume you have seven years of experience in the United States. Do You have seven years of work experience in the United States?
A.No

According to this resume you worked for JP Morgan Chase in New Jersey from January of 2014 untill “Till Date”. Did you ever work for JP Morgan Chase in New Jersey?
A.No

According to this resume you worked for HBC Inc in New York March of 2011 until November 2013.Did you ever work with HBC in New York?
A.No

Were you even in the United States from March of 2011 until November of 2013?
A.No

This resume goes on to state that you worked for Alleghany Energy in Pennsylvania from October of 2010 until March of 2011.Did you ever work for Alleghany Energy in Pennsylvania?
A.No

Where you in the United States from October of 2010 until March of 2011?
A.No

Why did you submit this Fraudulent Resume?
A.All this is from xxxxxxxx  from the first one I joined.I moved on from this company.It is not a good company.

You have submitted your resume since you started working from Jonam system Inc,why is that?
A.I only submitted that resume(Subject has a copy of his real resume) to USCIS for my H1B

You have e-mails sending this resume out in October 2015.why is this?
A.It is third party vendor.

Who is this third party vendor?
A.The guys based on e-mails or something.Not the person of Walgreens.

So you are submitting fraudulent resume to other vendors to try and find work?
A.yeah initially at that time.

So you are working for XXXXX Systems INC you were submitting fake resume to other vendors?
A.Yes

Did you believe that if you didn’t list fake work experiment that you wouldn’t be able to get a client?
A.No I could get a client

Then why did you submit fake resume?
A.It was getting delayed

You also have an e-mail with payrolls@xxxxinc.com where you tell them you haven’t been paid in over a month.Was this common occurrence to not be paid in a timely manner?
A.I was paid all the months.

Then why do you have this e-mail asking to be paid?
A.my employer paid me after 45days

you have another e-mail with the same recipient where you sate “ My payback was supposed to be run at 65K but it was ran at 60K”.Was it common for your employes to not properly pay you?
A.It happened just once .It was a misunderstanding.

You have an e-mail from again from payrolls@xxxxinc.com where you stated “ Could You explain why there is a cash advance deduction of 562.00 in my current paystub?”.How often did your employer deduct money from your pay check?
A.It was for my insurance

 

You are inadmissible under INA 212 (a)(7)(A)(i)(I) immigrant without valis immigrant visa.Do you understand?
A.Yes
