MLAs poaching case: Telangana seeks suspension of HC order

The Telangana government on Tuesday filed a petition in the state High Court, seeking suspension of the order pronounced on Monday in the MLAs’ poaching case so that it can challenge the same in the Supreme Court.

A division bench of the high court on Monday had dismissed the government’s appeal challenging the single judge’s order to transfer the investigation into the MLAs poaching case to the Central Bureau of Investigation (CBI).

A division bench, headed by Justice B. Vijay Sen Reddy, on Tuesday took up the petition for hearing. It, however, asked Advocate General B.S. Prasad to get the permission from Chief Justice Ujjal Bhuyan. The Advocate General conveyed to the bench that he would approach the Chief Justice on Wednesday.

The division bench of Chief Justice Bhuyan and Justice N Tukaramji had Monday dismissed the petitions of the state government and MLA Pilot Rohith Reddy challenging the order of the single judge transferring to the CBI the case relating to the alleged attempt to poach four legislators of the Bharat Rashtra Samithi (BRS).

It ruled that the single judge bench’s order can’t be faulted and interfered with.

On December 27, 2022, Justice B Vijaysen Reddy had ordered the transfer of the MLAs’ Poachgate case to the CBI. The High Court had also quashed a Government Order under which a Special Investigation Team (SIT) was constituted by the state government to probe the case.

The single judge had pronounced the order on the petitions filed by the accused priest Ramchandra Bharati, pontiff Simhayaji, and restaurant owner Nandu Kumar that they did not have faith in the SIT investigation.

The judge had also observed that the media should not have been given access to investigation material. He also noted that the state has not responded to the question who provided the Chief Minister with investigative materials.

During the hearing on appeal filed by the state government, Supreme Court advocate and senior counsel Dushyant Dave had faulted the order of the single judge for coming to a conclusion based on apprehensions of the accused and the BJP without any material beyond reasonable doubt.

Dave told the court that once evidence was submitted to the court, it becomes a public document and such revealing of public document by the Chief Minister to the media cannot be considered as leakage of material by the investigating agency. He pointed out that while the BJP was toppling state governments by luring MLAs from other parties, there was nothing wrong about the Chief Minister of Telangana bringing to the notice of millions of voters the politics played by the BJP.

The three accused were arrested by Cyberabad police from a farmhouse at Moinabad near Hyderabad on the night of October 26, 2022 when they were allegedly trying to lure four MLAs of BRS with offers of huge money.

Cyberabad police conducted the raid on a tip-off by Pilot Rohith Reddy, one of the MLAs. He alleged that the accused offered Rs 100 crore to him and Rs 50 crore each to three others to make them defect to the BJP.

The state government had subsequently constituted SIT headed by Hyderabad Police Commissioner C.V. Anand to probe the case.

MLAs’ poaching case: Telangana govt challenges order transferring case to CBI

The Bharat Rashtra Samithi (BRS) government in Telangana has filed an appeal in the Telangana High Court challenging the court order transferring the case relating to alleged attempts to poach BRS MLAs to the Central Bureau of Investigation (CBI).

The government has challenged the order passed by a single-judge bench directing the CBI to probe the sensational case.

The appeal is likely to be taken up for hearing by a division bench headed by Chief Justice Ujwal Bhuyan.

On December 26, Justice B. Vijaysen Reddy had entrusted the investigation into the MLAs’ poaching case to the central agency after hearing the petitions filed by the accused persons, who argued that they have no faith in the probe by the Special Investigation Team (SIT) constituted by the state government.

The court had then quashed the government order constituting the SIT to probe the case. However, following a plea filed by the government, the court stayed implementation of the order till the copies of the judgement are made available.

After studying the judgement, the BRS government decided to file the appeal.

Incidentally, the high court had dismissed a petition seeking CBI probe into the matter in November last year. However, accused Ramachandra Bharati, K. Nanda Kumar and D.P.S.K.V.N. Simhayaji had moved the Supreme Court, which then directed the high court to decide on the petitions seeking transfer of probe to the CBI.

The state government had subsequently constituted an SIT headed by Hyderabad Police Commissioner C.V. Anand to probe the case.

BJP General Secretary B.L. Santosh; Bharath Dharma Jana Sena (BDJS) President Tushar Vellapally; a doctor from Kerala, Jaggu Swamy; lawyers Srinivas and Pratap Goud; and Nanda Kumar’s wife Chitralekha were also summoned by the SIT for questioning.

Santosh, Vellapally and Jaggu Swamy had approached the high court and secured a stay on the notices.

The high court had on December 1 granted conditional bail to the accused persons.

However, Ramachandra Bharati and Nanda Kumar were re-arrested by the police soon after their release from jail on December 8 in connection with some other cases registered against them.

While Ramachandra Bharati was booked for holding multiple passports, Aadhaar cards and other documents, five cases were registered against Nanda Kumar for cheating and other offences.

MLAs poaching case: Telangana HC upholds lower court order

The Telangana High Court on Monday dismissed an appeal by the Special Investigation Team (SIT) challenging order of a special ACB court which had aside a memo to array BJP national General Secretary B.L. Santhosh and three others as accused in the MLAs’ poaching case.

The ACB special court had last month rejected the memo and the SIT had challenged this in the High Court.

The ACB special court had observed neither police nor SIT is competent to investigate the offences relating to the Prevention of Corruption Act and only the Special Police Establishment/Anti-Corruption Bureau is the competent authority to do so.

Arguing in the High Court, Advocate General B.S. Prasad had submitted that the ACB court crossed its limits with the order rejecting the memo.

He submitted to the court that the SIT decided to add Santhosh, Kerala politician Tushar Vellapally, Kerala-based doctor Jaggu Swamy, and lawyer B. Srinivas as accused in the case on the basis of evidence found against them during the course of investigation.

Why is BJP celebrating HC verdict in MLAs’ poaching case, asks KTR

Bharat Rashtra Samithi Working President K.T. Rama Rao on Tuesday came down heavily on the Bharatiya Janata Party (BJP) and Union Minister Kishan Reddy for celebrating the high court order transferring the MLAs’ poaching case to the Central Bureau of Investigation (CBI).

Rama Rao hit back at Kishan Reddy who called the court order a “victory” for the BJP.

Posing a number of questions to Kishan Reddy, KTR, as the leader is popularly known, said the the BJP leaders stand exposed.

“When the accused Swamijis were caught openly, you said you had no connection with them and now when the case is transferred to the CBI, you are celebrating it. Is it because the case is now with your puppet agency?” he asked.

The minister questioned if they have no connection with the accused, why did they move the court multiple times and interfered in the investigation. “You are now publicly claiming that the BJP will get a clean chit as the case is with the CBI. This only proves how the central investigation agencies are compromised in the ruling of the BJP,” said KTR.

He remarked that earlier, the accused used to feel afraid if the case got transferred to the CBI, but now they are celebrating.

KTR added that the BJP has overtaken the Congress in misusing the investigating agencies. “Earlier, people used to call the CBI ‘Congress Bureau of Investigation’, but now people are calling it ‘Central BJP Investigation’,” he said.

KTR dared Kishan Reddy if they are ready for a narco analysis and lie detector test on the accused so that the BJP’s relationship with the accused will be clear.

He said that the “crooked” BJP is behaving as if they can do anything with the power. “We don’t have any need to denounce the BJP. They were already denounced by the public itself for their eight-year rule,” he said.

The minister added that as the BJP doesn’t have any achievement on their name to claim they are resorting to vicious propaganda on the opposition parties. “Is it not true that your party is poaching MLAs and toppling the democratically-elected state governments?” the minister questioned. He added that the BJP’s Operation Lotus failed miserably in Telangana and they were caught red-handed.

KTR said that the nation knows how the investigation will be done by BJP’s puppets. “BJP can’t escape the punishment in the people’s court,” he said. KTR added that the country is waiting for the right time to give a befitting answer to the BJP.

The Bharat Rashtra Samithi (BRS) government is likely to file an appeal against Telangana High Court order transferring MLAs’ poaching case to the Central Bureau of Investigation (CBI)

BRS MLA Pilot Rohith Reddy, who was the complainant in the case, said after receiving the copy of the court order, they would analyse it and decide their future course of action.

“We will study the order and then decide whether to go for an appeal in the High Court or approach the Supreme Court,” the BRS legislator told reporters after a single judge bench of the High Court handed over the case to the CBI.

Justice B. Vijaysen Reddy pronounced the orders on the petitions of the accused who argued that they have no faith in the investigation by the Special Investigation Team (SIT) constituted by the state government.

The judge quashed the Government Order (GO) issued by the state government constituting the SIT to probe the case.

On a request by the state government, the High Court kept in suspension its order until the final copy of the judgment is received.

Rohith Reddy voiced the apprehension that the BJP may use the CBI to shield the accused who were caught red-handed while trying to lure the four MLAs with offers of huge money to make them switch loyalties to the BJP.

He reiterated that the BJP was using its ‘trishul’ (trident) of the CBI, Enforcement Directorate (ED) and the Income Tax (IT) against its political opponents.

The MLA said since they used ED against him but found nothing, they will now use CBI.

Rohith Reddy said he had filed a petition in the High Court challenging his questioning by the ED in the case. He wondered why the Central agency was questioning the complainant and not the accused.

Meanwhile, the BJP welcomed the court order and termed it a victory of the truth. Its leaders said the BRS tried to use the case to malign BJP.

BJP leader and lawyer Ramchandra Rao said the way the police handled the case had raised doubts from the beginning. He pointed out that Chief Minister K. Chandrasekhar Rao had addressed a press conference to make public evidence in the case.

The Special Investigation Team (SIT) of Telangana police probing MLAs’ poaching case on Wednesday approached the Telangana High Court challenging an order of ACB special court rejecting a memo to array BJP national general secretary B.L. Santhosh and three others as accused.

The High Court took up the hearing of the petition filed by the SIT challenging the lower court’s order.

Advocate General B.S. Prasad argued that the ACB court crossed its limits with the order rejecting the memo. He submitted to the court that the SIT decided to add Santhosh, Tushar Vellapally, Jaggu Swamy and B. Srinivas as accused in the case on the basis of evidence found against them during the course of investigation.

The High Court directed the Advocate General to serve notice to lawyers of the accused and adjourned the hearing to Thursday.

The ACB special court had rejected the memo saying neither law and order police nor SIT is competent to investigate the offences relating to the Prevention of Corruption Act and only the Special Police Establishment Anti-Corruption Bureau is the competent authority to do so.

The accused were booked under Indian Penal Code (IPC) sections 120B (criminal conspiracy), 171B r/w 171E (bribery), 506 r/w 34 (criminal intimidation) section 8 of Prevention of Corruption Act.

The SIT headed by Hyderabad Police Commissioner C. V. Anand had served notices to Santhosh, NDA convenor in Kerala Tushar Vellapally, Kerala-based doctor Jaggu Swamy and lawyer B. Srinivas for questioning.

Of them, only Srinivas appeared before the SIT while others approached the High Court and obtained stay.

The names of Santhosh, Tushar and others figured in the conversation between the alleged BJP agents and the TRS MLAs.

The High Court on December 1 granted bail to three accused in the case.

BJP’s Santhosh not cooperating, SIT to Telangana HC

With BJP General Secretary B.L. Santhosh and two others not appearing before the Special Investigation Team (SIT) of Telangana Police probing MLAs’ poaching case despite the summons, the SIT approached the Telangana High Court on Tuesday.

The SIT informed the court that Santhosh was served notice through Delhi Police but he did not appear before it. The court was told that the top BJP functionary is not cooperating in the investigation.

Since a single judge bench of the High Court is monitoring the probe into the case, the SIT apprised the court of the progress of the investigation.

Tushar Vellapally, President of Kerala’s Bharath Dharma Jana Sena (BDJS) and Jaggu Swami have also not appeared before SIT, which has reportedly issued a lookout notice for them.

The trio, along with Bhusarapu Srinivas, a lawyer from Karimnagar, was issued notices by the SIT last week asking them to appear for questioning in Hyderabad on November 21.

However, only Srinivas, who is said to be a relative of Telangana BJP President Bandi Sanjay Kumar, appeared before the investigating team.

For a second consecutive day on Tuesday, Srinivas appeared before the SIT officials. He was grilled for about seven hours.

Srinivas had allegedly funded the flight expenses for Simhayaji, one of the three accused arrested for the alleged attempt to buy four MLAs of the ruling Telangana Rashtra Samithi (TRS).

He, however, told reporters that he booked the flight ticket for Simhayaji out of respect for him. He denied any links with the BJP or the MLAs’ poaching case.

The Telangana High Court had on November 19 turned down the request of BJP state unit to stay the notice issued to Santhosh.

Justice B. Viajaysen Reddy, however, made it clear that Santosh should not be arrested since the SIT had already issued notice to him under Section 41A of Criminal Procedure Code. The judge observed that Santhosh should not apprehend his arrest and asked him to comply with the conditions imposed in the SIT notice.

The same day the High Court heard an application filed by the Telangana government seeking instruction to Delhi Police Commissioner to cooperate with the SIT in serving notice to Santhosh. The judge ordered that notice should be served to the top BJP functionary without any further delay. He allowed SIT to serve notice to Santhosh through an e-mail or WhatsApp to the Delhi Police officer concerned.

Santhosh’s name figured in the conversation between three alleged BJP agents arrested by the police last month while trying to lure four MLAs of the TRS to the BJP fold with an offer of huge money.

The SIT also served notices to Kerala doctor Jaggu Swami, and BDJS President Vellapally for questioning.

All the four were summoned on the same day for questioning for their alleged links with the three accused arrested in the case last month.

Jaggu Kottilil alias Jaggu Swami is working in Amrita Institute of Medical Sciences in Kochi while Vellapally is leader of BDJS, an ally of BJP in Kerala.

The name of Vellapally, who had contested the 2019 Lok Sabha election from Wayanad against Congress leader Rahul Gandhi, figured in the conversation the three accused had with the TRS MLAs.

Ramachandra Bharati, the main accused, reportedly confessed that Jaggu Swami was linked to the cash that was promised to the TRS MLAs as inducement.

Bharati alias Satish Sharma, Simhayaji and Nandakumar were arrested by the Cyberabad police from a farmhouse at Moinabad near Hyderabad on the night of October 26 when they were allegedly trying to lure four MLAs of the TRS with offers of huge money.

Cyberabad police conducted the raid on a tip-off by Pilot Rohit Reddy, one of the MLAs. He alleged that the accused offered Rs 100 crore to him and Rs 50 crore each to three others.

The accused were booked under various sections of the Indian Penal Code (IPC) and Prevention of Corruption Act.

The Telangana High Court last week rejected the BJP plea to hand over MLAs’ poaching case to the CBI but ruled that a single judge will monitor the investigation into the case.

It asked the SIT to submit a report to the court on November 29 on the progress of the investigation.

Meanwhile, a special ACB court adjourned to Wednesday hearing on the petition filed by SIT seeking custody of the three accused for a week.

The SIT, which earlier questioned the accused for two days, submitted to the court that it needs their custody for another one week to collect more information from them about those who may be involved in the case.
