“Bhanwar Lal has to pay price for deletion of voters”

With High Court taking cognizance of the petition filed against the Election Commission and GHMC, Dr Marri Sashidhar Reddy, the man who single handedly fought against the deletion of names from the voter list of several “Seemandhra voters” said he was ready to prove the complicity of chief minister K Chandrasekhar Rao in the whole episode.

Talking to telugu360.com Dr Reddy said he had evidence to prove that the CM was involved in the murky affair of removing the names of hostile voters from areas where the CM feared he would not get votes. “And the CEO has to pay price for his role in the deletion of names of voters from the list” he said.

“I will take the issue to the logical conclusion. I know when the CM summoned CEO Bhanwar Lal to the Camp Office along with other officials related to the revision of voters list in the GHMC area. CM’s summoning of officers on deputation to Election Commission was wrong. And officials were equally wrong in attending a meeting summoned by the chief minister,” he said. According to Reddy, the meeting took between the CM and the other election officials took place on July 21, 2015.

Reddy said in the meeting removal of names had been discussed and a target of 15 lakh was fixed for the deletion of names on the pretext eliminating the bogus voters.

” Somesh Kumar had been shifted from GHMC for his role in the dubious activity. The team, deputed by the EC to look into the matter seems to have found substance in the charges of political parties. So, he was shifted immediately. Now, I want to pursue the matter till it reached the logical conclusion. I will take up the matter with Election Commission till an action is taken against Bhanwar Lal,” Reddy said.

Reddy said the CEO committed impropriety and violated the 13 cc of the Representation of People’s Act which specifies that the Chief Electoral Officer and District Election Officers were deemed to be on the deputation to the Election Commission and they were subject to the control, superintendence and discipline of the Election Commission”. ” When the Act is so specific about the role of the election officials on deputation to the Election Commission, how could a chief minister summon and give directions to the CEO and how the latter oblige,” he asked.

Reddy says the CM had insisted on deletion of ‘bogus voters’ en masse from electoral rolls as their continuance would undermine the electoral process in the GHMC area. “The meaning of this is that in many areas in GHMC area the voters are ranged against the TRS. The CM knows it pretty well. By applying Aadhar card many of these could become bogus voter as many of them do not possess it. This is sheer abuse of position,” he said. He cited the case of Uttar Pradesh where UP State government had to suspend senior officers including the District Election Officer of Moradabad and others in the case of illegal deletion of 15,800 names of voters in Thakurdwara assembly constituency, a segment of Rampur LS constituency. The case of GHMC voter deletion is certain to set a new trend in prevention of manipulative politics in the country, he said.

Intensifying his campaign for the removal of TDP MLA and commercial taxes minister Talasani Yadava from Telangana cabinet,  former MLA Marri Sashidhar Reddy on Saturday dashed off a letter to union home minister Rajnath Singh urging him to relieve   Governor ESL Narasimhan of his responsibilities for protecting the minister unconstitutionally.

He urged the union minister to direct Governor ESL Narasimhan to remove Yadav from chief minister K Chandrasekhar Rao’s cabinet immediately as he completed six months in the cabinet. He charged Governor with deliberately allowing Srinvas Yadad in the cabinet without seeking his resignation as per the constitutional provision.

“The Governor deliberately chose to ignore paragraph 2 (1)(a) of Tenth Schedule of the Constitution and the ruling by the Constitutional Bench of Hon. Supreme Court of India, in the Rajender Singh Rana Vs Swami Prasad Mauray case delivered on 14-2-2003. The SC is very clear with regard to  he continuance of a person beyond six months as a minister which the Court said is unconstitutional. The Governor of Telangana, as the custodian of the constitution, has violated not only the constitutional provison but also judgement of Hon’ble Supreme Court, which is unpardonable”.

He urged union home minister to relieve the Governor immediately of his responsibilities as he as deliberately faltered and blatantly failed to discharge his duties.

Sashidhar Reddy was the former MLA of Sanathnagar which is now represented Talasani Srinivas Yadav.

Marri Sashidhar Reddy, a senior Congress leader and former MLA from Sanathnagar, Hyderabad, leveled a serious charge against Governor ESL Narasimhan for his alleged constitutional impropriety.

He cautioned Governor against becoming another Ram Lal.

According to Reddy, governor failed on two counts in upholding the constitutional values in Telangana.

  1. He administers of oath office to an MLA who was facing anti-defection charges
  2. He is allowing the minister to continue to hold office even after six month instead asking him to face elections.

Ram Lal, was Governor, when NT Ramarao was toppled by Nadendla Bhaskhar Rao, NTR’s finance ministery,in a coup of sorts, way back in August 1984. There was a hue and cry against Ram Lal’s constitutional impropriety in removing NTR and allowing Nadendla form government when the former was in US undergoing treatment. Later, buckling under the pressure from people across the country, Ram Lal was removed by the centre.

Sashidhar Reddy accused of Narasimhan of same constitutional impropriety for administering oath of office and secrecy to TDP MLA Talasani Srinivasa Yadav as a minister in KCR’s cabinet. Incidentally, Talasani wrested the Sanathnagar seat from Sashidhar Reddy in 2014. But he defected to TRS and a petition seeking his disqualification under anti-defection law is under consideration of the speaker. The question Sashidhar Reddy was asking that,”can a governor ignore the constitutional status of a defected MLA and administer oath of office?”

“Governor was aware that Talasani was elected to Assembly as TDP candidate in 2014. He was inducted into cabinet on December 16, 2014 and  completed six months,” he said in a letter addressed to the governor.

“You administered,” he said in the letter, “oath of office to Talasani as a minister in the government run by TRS, which is not the political party through with which he won as a legislator.”

“Instead of protecting and upholding the constitution, you are protecting the unconstitutional acts and activities of the Telangana government. People of the state still remember the infamous Governor Ram Lal and feel that, hopefully, we should not see another one in the making.
