Telangana HC extends stay on SIT notice to BJP leader Santhosh

The Telangana High Court on Tuesday extended the stay on the notice issued to BJP national General Secretary, Organisation, B.L. Santhosh and Kerala-based doctor Jaggu Swami in the MLAs poaching case.

The High Court extended the stay till December 22 on notices issued by the Special Investigation Team (SIT) probing the case.

The court restrained the SIT from taking any action with regard to the notices issued to the duo under Section 41A of the Criminal Procedure Code.

The court had earlier stayed notices issued to senior BJP leader and the doctor till December 13.

The stay was extended by the court while hearing quash petitions filed by the petitioners.

Kottilil Narayan Jaggu alias Jaggu Swami also challenged a lookout notice issued for him by the probe team.

The SIT issued a lookout notice for Jaggu Swami on November 22, terming him a wanted person in the case.

The names of Santhosh and Jaggu Swami figured in the conversation between three alleged BJP agents arrested by the police in October while trying to lure four MLAs of TRS to the BJP fold with an offer of huge money.

The High Court earlier this month granted bail to three accused.

Ramachandra Bharati, Nand Kumar and D.P.S.K.V. Simhayaji were granted conditional bail by the court.

They were arrested by the Cyberabad police from a farmhouse at Moinabad near Hyderabad on the night of October 26 when they were allegedly trying to lure four MLAs of TRS with offers of huge money.

Cyberabad police conducted the raid on a tip-off by Pilot Rohit Reddy, one of the MLAs. He alleged that the accused offered Rs 100 crore to him and Rs 50 crore each to three others.

The SIT has added Santhosh, Tushar Vellapally, Jaggu Swami, and advocate B. Srinivas as the other accused in the sensational case.

The accused have been booked under Indian Penal Code’s (IPC) Sections 120B (criminal conspiracy), 171B r/w 171E (bribery), 506 r/w 34 (criminal intimidation) and Section 8 of Prevention of Corruption Act.

BJP national general secretary (organisation) B.L. Santhosh and Kerala-based doctor Jaggu Swamy whose name figured in the MLA poaching case in Telangana, received relief on Monday after the High Court granted a stay on the notice issued by the Special Investigation Team (SIT) probing the matter.

The High Court issued stay on notices issued to Santhosh and Jaggu Swamy till December 13.

The court restrained the SIT from taking any action with regard to the notices issued to the duo.

The stay was issued by the court while hearing quash petitions filed by the petitioners.

Santhosh filed a quash petition challenging the 2nd 41 A CrPC notice dated November 23, issued to him by SIT police in the MLA poaching case.

The court had earlier stayed notice issued to senior BJP leader till December 5.

Kottilil Narayan Jaggu a.k.a. Jaggu Swami had also filed a quash petition, challenging the notice served to him by the SIT and also the subsequent lookout notice issued for him by the probe team.

Arguing that he is no way involved in the case, the petitioner has sought stay on the proceedings against him.

The SIT issued a lookout notice for Jaggu Swami on November 22, terming him a wanted person in the case.

Last week, the High Court granted bail to three accused in the case.

Ramachandra Bharati, Nand Kumar and D.P.S.K. V. Simhayaji were granted conditional bail by the court.

BJP national general secretary (organisation) B.L. Santhosh whose name figures in the MLAs poaching case in Telangana, got relief on Friday after the High Court granted a stay on the notice issued by the Special Investigation Team (SIT) probing the matter.

The High Court issued stay on notice issued to Santhosh till December 5.

The stay was issued after the senior BJP leader filed a petition challenging the 2nd 41 A CrPC notice dated November 23, issued to him by the SIT of the police in the MLA poaching case.

The notice was stayed by the court on the grounds that it did not mention the evidence or grounds under which it was served, as required under Section 41-A.

The counsel of B.L. Santhosh had submitted that the SIT had not mentioned any of these points in the notice served to the BJP leader.

Court asks T’gana SIT to serve fresh notice to B.L. Santosh

The Telangana High Court on Wednesday asked the Special Investigation Team (SIT) probing MLAs’ poaching case to issue fresh notice to BJP general secretary B.L. Santosh.

Justice B. Vijayasen Reddy asked the SIT to serve the notice through email and WhatsApp. He, however, dismissed the plea by the state to lift the stay on the top BJP functionary’s arrest.

The SIT has also been directed to file a status report on the investigation on November 29. The next hearing will take place on November 30.

The SIT submitted to the court that Santosh is not cooperating in the investigation by not appearing before it.

The BJP leader was already served notice under Section 41A of Criminal Procedure Code. He was directed to appear before SIT on November 21. He, however, stayed away.

The SIT approached the court and sought direction to Santosh to appear for questioning. The court felt that it is the responsibility of the BJP leader who had earlier filed a petition to stay the notice served on Santosh to ensure that he makes himself available to the SIT.

The High Court on November 19 had turned down the request of petitioner to stay the notice issued to Santosh.

The judge, however, made it clear that Santosh should not be arrested as the SIT had already issued notice to him under Section 41A of Criminal Procedure Code. The judge observed that Santosh should not apprehend his arrest and asked him to comply with the conditions imposed in the SIT notice.

The high court had also heard an application filed by the Telangana government seeking instruction to Delhi police commissioner to cooperate with the SIT in serving notice to Santosh. The judge ordered that notice should be served to the top BJP functionary without any further delay.

During the hearing on Tuesday, the SIT informed the court that Santosh was served notice through Delhi police.

The SIT had summoned Santosh and three others on November 21. Only Bhusarapu Srinivas, a lawyer from Karimnagar, appeared before SIT on Monday and Tuesday.

The SIT on Tuesday issued a lookout notice for Bharath Dharma Jana Sena (BDJS) president Tushar Vellapally and a doctor from Kerala, Jaggu Swamy as the probe team failed to locate their whereabouts. Circulars were also issued to prevent them from leaving the country.

The SIT on Wednesday served notice on two more persons. Pratap Goud, a lawyer from Amberpet area of Hyderabad, and Chitralekha, wife of Nanda Kumar, one of the three accused in the case, have been summoned for questioning.

TRS MLAs’ poaching case: SIT summons BJP leader Santosh

In a major development in MLAs’ poaching case, the Special Investigation Team (SIT) of Telangana Police has summoned BJP General Secretary B.L. Santosh.

The SIT has served notice to the BJP leader under Section 41A of the Criminal Procedure Code asking him to appear before it on November 21.

Santosh has been directed to come to the Police Command and Control Centre in Hyderabad at 10.30 a.m. The SIT has stated in the notice that if he fails to appear before it, he will be arrested.

Santosh’s name figured in the conversation between three alleged BJP agents arrested by the police last month while trying to lure four MLAs of the TRS to the BJP’s fold with an offer of huge money.

The SIT has already served notices to Kerala doctor Jaggu Swami, BDJS President Tushar Vellapally and a lawyer and relative of Telangana BJP President Bandi Sanjay Kumar for questioning.

All the four have been summoned on the same day. They have been asked to appear before SIT for questioning for their alleged links with the three accused arrested in the case last month, sources said.

Jaggu Kottilil alias Jaggu Swami is working in Amrita Institute of Medical Sciences in Kochi while Tushar Vellapally is President of Kerala’s Bharath Dharma Jana Sena (BDJS).

A team, led by Nalgonda Superintendent of Police Rema Rajeshwari, a member of SIT, served the notices after its investigation in Kerala during the last five days.

The team served notice at Vellapally’s house in Alappuzha. Vellapally, whose BDJS is an ally of the BJP in Kerala, was not home.

The name of Vellapally, who had contested the 2019 Lok Sabha election from Wayanad against Congress leader Rahul Gandhi, figured in the conversation the three accused had with the TRS MLAs.

The notice was pasted at the office and house of Jaggu Swami, who is reported to be absconding. The police team was in Kerala to question him as Ramachandra Bharati, the main accused reportedly confessed that Jaggu Swami was linked to the cash that was promised to the TRS MLAs as inducement.

SIT has also served a notice to Bhusarapu Srinivas, a lawyer from Karimnagar, who is said to be a distant relative of the Telangana BJP chief.

Srinivas had allegedly funded the flight expenses for Simhayaji, one of the three accused.

The Telangana High Court on Tuesday rejected the BJP plea to handover MLAs’ poaching case to the CBI but made the SIT probing the case independent.

The court also ruled that a single judge will monitor the investigation into the case.

It asked the SIT to submit a report to the court on November 29 on the progress of the investigation.
