Mansas Trust case: AP High Court rules in favour of Ashok Gajapathi Raju

0

The AP High Court on Wednesday (today) dismissed petitions filed by Andhra Pradesh government and Sanchaitha Gajapathi Raju challenging the orders passed by single judge reinstating TDP senior leader P Ashok Gajapathi Raju as chairman of Manas Trust.

The AP High Court upheld the orders passed by single judge and ruled that Ashok Gajapathi Raju will continue as chairman of Mansas Trust.

Sanchaitha also filed three separate petitions challenging the single judge order.

However, the division bench of AP High Court headed by Chief Justice Arup Kumar Goswami dismissed all these petitions.

It may be recalled that AP government had filed three appeal petitions in July arguing that the single judge erred in his judgment which was based on the will deed which has become void.

It may be also recalled that the government had removed Ashok as chairman of Mansas trust and Simhachalam temple trust on March 3, 2020, and appointed Sanchaitha Gajapathi Raju in his place by recognising her as the founder family member.

Ashok challenged his removal in the high court, arguing that he was removed arbitrarily without following due procedure. He also stated that his removal was against the trust deed which stipulates that only the eldest male lineal descendants can be appointed as chairman of the trust.

The government defended its move, arguing that Sanchaitha was eligible for the position and cannot be discriminated based on gender.

The high court, however, set aside the GO and reinstated Ashok as chairman of the two trusts. But AP government appealed against the order, arguing that the single judge made an error in his judgement while ruling in favour of Ashok based on the trust deed which has become void after the 1987 legislation which abolishes all hereditary trusties.

The government has also argued that Sanchaitha has preferential right of succession over Ashok according to Hindu Succession Act.

Follow Ashok’s orders: AP High Court directs Mansas EO!

1

The Andhra Pradesh High Court today (Tuesday) directed Mansas Trust EO (executive officer) Satyanarayana to follow the orders issued by Mansas Trust chairman, senior TDP leader Ashok Gajapathi Raju.

Raju filed contempt petition against EO stating that EO was not cooperating with him in discharging his duties as chairman in violation of earlier HC orders.

The High Court expressed anger at EO and directed him to obey orders issued by chairman Raju.

The court also directed EO to immediately pay salaries for staff working in Mansas Trust .

The court also cancelled orders issued by EO convening meeting of executive council.

The court directed EO not to involve others in auditing of Trust accounts.

The court asked EO to audit accounts only with auditor.

Though High Court struck down Jagan government’s earlier orders of removing Raju from chairman post and reinstated him as chairman, officials of Mansas Trust are not cooperating with Raju reportedly due to instructions from Jagan government.

Raju moved High Court filing contempt case against officials.

Mansas Trust: The game is not over yet

0

The game over Mansas Trust, belonging to the Gajapathi royalty, it appears, is still not over. Though the High Court has given the verdict clearly in favour of TDP biggie and North Andhra stalwart Ashok Gajapathi Raju, the YSRCP is clearly in no mood to relent. It is planning counter moves.

The YSRCP government is now planning to appoint a ‘forensic audit committee’ to look into the ‘illegalities’ in the functioning of the trust. The committee comprises the endowments commissioner and four joint commissioners. On Wednesday, a key meeting on endowment lands was held in Visakhapatnam ZP office. Rajya Sabha MP Vijayasai Reddy, Endowments Minister Vellampally Srinivas, ministers Kurasala Kannababu and Muthamsetti Srinivasa Rao were present.

Speaking on the occasion, Vijaysai said that they would challenge the high court order in the division bench and get the orders reversed. He said the government was committed to protect the 14000 acres of Mansas lands. He charged Ashok Gajapathi Raju with giving 6000 acres of temple lands of Srikakulam Sitaramaswamy temple and Venugopala Swamy temple in Bobbili to others. He said the Rajus were eating up lands of the Trust. He also said that a probe would be ordered into the ‘fake’ GO of 2016, which enabled Ashok Gajapathi Raju to sell off 115 acres of land.

All this indicates that the fight over the Mansas Trust is far from over. While Ashok Gajapathi will try to assert his rights over the Trust, the YSRCP government is trying everything it can to take the Trust into its hands. While Ananda Gajapathi Raju’s daughter Sanchayita’s chapter may be over, the tussle for supremacy is still open. The government will try to rein in Raju through the ‘forensic audit’ and also challenge him in the HC division bench. The game has only begun, according to sources.

HC ruling on Mansas is ultimate victory of justice: TDP

1

Telugu Desam Party national general secretary and Andhra Pradesh opposition leader Nara Lokesh called the High Court’s judgment to rescind the state government’s orders on Maharaja Alak Narayana Society of Arts and Science (MANSAS) and the reinstatement of Ashok Gajapathi Raju as its chairman, as the ultimate victory of law and justice.

“With the High Court cancelling the government’s GOs on Mansas Trust, it has been proved that law and justice are the ultimate winners,” said Lokesh.

He claimed that this ruling is a slap in the face of the government which is allegedly issuing undemocratic and unconstitutional dark orders at midnight.

The TDP leader exhorted that the judgment brought more glory to the Pusapati family which donated land and assets worth thousands of crores of rupees.

“This is the victory of public love, law, justice and the Constitution with the blessings of Simahachalam Appanna,” said Lokesh and congratulated Raju.

Likewise, TDP supremo and former chief minister Nara Chandrababu Naidu welcomed the judgment and termed it as a slap in the face of ‘Tughlaq CM’, hinting at Chief Minister Y.S. Jaganmohan Reddy.

“Finally, the long arm of the law and the inexorable wheels of justice have put a full stop to Reddy’s nefarious plans to plunder thousands of acres of prime lands and multi-crore properties belonging to the temples that are run by the Mansas Trust,” claimed Naidu.

According to the TDP chief, the Court’s order would give a new lease of life to thousands of students and employees.

However, AP Endowments Minister Vellampalli Srinivas said the government will appeal in the Supreme Court against the judgment.

AP govt to appeal against HC orders on Mansas Trust!

0

After receiving a jolt in the Andhra Pradesh High Court on Monday over Mansas Trust issue, the AP government has decided to appeal against High Court orders, which struck down GO (government order) issued by Jagan government removing TDP leader P Ashoka Gajapathi Raju from the post of chairman of Mansas Trust, Simhachalam Temple Board and appointing Anand Gajapathi Raju’s daughter Sanchaita as director of Mansas Trust.

The High Court on Monday ordered the re-appointment of Ashok Ganapathi Raju as the chairman of the two trusts and cancelled the appointment of the Sanchaita.

AP endowments minister Vellampalli Srinivas met Chief Minister YS Jaganmohan Reddy soon after court verdict and brief him about the judgment.

Jagan reportedly asked Vellampalli to appeal against High Court orders. He also reportedly asked Vellampalli to move Supreme Court if High Court delivers the same verdict on the appeal petition.

Ashok Gajapatiraju argued before the High Court that the elders should be the trustees in their old age as they are a hereditary trust and opined that the AP government has appointed the chairman of these trusts against the rules. The government has argued that the appointment was made in accordance with the rules.

However, High Court agreed with the arguments submitted by Ashok Gajapati Raju and stuck down GO issued by AP government in this regard removing him from the post.

Sanchaita Gajapathi follows Jagan, shifting MANSAS office

2

Shiftings, cancellations, demolitions, etc have become common nowadays in Andhra Pradesh. Amaravati is technically located at a central point in the State but CM Jagan is shifting it in the name of decentralisation. Now, Sanchaita Gajapathi Raju is also following in the same direction.

All of a sudden, Sanchaita has ordered overnight shifting of the MANSAS office from the Maharajah Fort in Vizianagaram to Visakhapatnam. She has also instructed removal of most of the old office staff in order to make it completely filled with her own people. The executive officer is saying that the MANSAS office shifting is taken up as part of the drive for modernising the trust activities.

However, there are growing allegations that Sanchaita has taken this shifting decision only to escape from the rising protests from the local people in Vizianagaram district. The MANSAS colleges and institutions are a matter of emotion and prestige for the people there.

The latest decision gave rise to further suspicions that the YCP leaders were moving forward with their agenda to get full control over the multi-crore MANSAS properties. There have been allegations that Sanchaita is just a puppet brought by Vijay Sai Reddy to disturb and undermine MANSAS.

Which Gajapathi will save MANSAS? Sanchaita or Ashok

0

Ever since the YCP came to power, the North Andhra socio-political scene has been seeing rising political temperatures. The Gajapathi Rajus’ royal family is witnessing the deepest cracks ever seen in recent history. With the backing of Vijay Sai Reddy, MANSAS Chairperson Sanchaita Gajapathi Raju is targetting and undermining all other members of the royal family. Recently, she engaged her own step sister Urmila Gajapati Raju in a bitter feud.
Now, Sanchaita targetted her attack on Ashok Gajapathi Raju. This is in the wake of ‘Save Mansas’ agitation picking up momentum in the North Andhra region. In view of the rising heat, Sanchaita took to Twitter and described the ongoing agitation as a ‘Save Ashok’ campaign. She said that Ashok has started it only to save his dwindling political career in the wake of coming to light of his scams in MANSAS one by one. Sanchaita declared that it was she who was making every effort to save MANSAS but not the TDP or anybody else.
Taking the discourse to a new low, Sanchaita has even called Ashok’s plans as cheap politicking. She went on to level allegations against him. She asked why Ashok did not start ‘Save MANSAS’ agitation when the 150 year old Moti Mahal was razed to the ground. He also kept mum without engaging any lawyer in his capacity as Trust Chairman when Rs 13 Cr worth property of MANSAS fell in the hands of private persons in the form of a court decree.
Sanchaita further said that Ashok gave over 8,000 acres of MANSAS to his followers on lease at a minimal rate of Rs. 500 which was very low compared to market rates. Seeing the bitterness exhibited by her, it seems Sanchaita will take the MANSAS dispute to its logical end sooner than later.

MANSAS Trust appeals to Jagan govt to privatise MR College

2

In yet another controversial decision, the MANSAS Trust on Wednesday appealed to the state government to privatize Maharajah’s Educational Institutions or M R College which is one of the oldest autonomous colleges in the country.
The institution was founded by Pusapati Vijaya Rama Gajapathi Raj-III, the then Maharajh of Vijayanagaram princely state, in 1879. MANSAS was formed as a society in 1958 by PVG Raju in the name of his father to promote the cause of education and continue to administer the educational institutions under the patronage of their family. The trust was set up with an endowed property of over 13,000 acres and other properties to provide financial support for the educational institutions under MANSAS.

MANSAS Trust, whose chairperson is Sanchaita Gajapati Raju and daughter of Uma Gajapati Raju, estranged wife of late Ananda Gajapati Raju, has appealed to the state government to privatise MR College which runs Intermediate and Degree courses.

The Higher Education Committee Special Commissioner has directed the Regional Joint Director of Education to look into the appeal. The MANSAS trust appeal to privatize MR College has pushed the teaching staff into deep anguish and anxiety.

Anand Gajapati Raju and Ashok Gajapati Raju were founding members of the MANSAS trust board. However, Sanchaita Gajapati Raju replaced her uncle and former Union minister Ashok Gajapati Raju, who has been heading both MANSAS and Simhachalam trust board since the demise of his brother Ananda Gajapati Raju. He was removed from the MANSAS trust board chairman and Sanchaita Gajapathi Raju was appointed in the post by the Jagan government.
