High Court notices to AP Govt on Sawhney appointment

The High Court of Andhra Pradesh has once again given notices to the AP Government based on a fresh petition that challenged the appointment of State Election Commissioner Nilam Sawhney. The petitioner’s advocate said that the appointment of Ms. Sawhney was unconstitutional and in violation of the Supreme Court orders. The petitioner sought the removal of Ms. Sawhney from the post immediately.

The High Court admitted the petition, took up hearing and issued notices to the Government for its response. Since yesterday, there has been an all out attack on the SEC from the Opposition parties. The High Court had questioned the suitability of Ms. Sawhney for the post of SEC earlier while cancelling the MPTC and ZPTC elections. The judges of the AP High Court have been freely expressing their observations against the Jagan Reddy regime freely now.

The judges were especially unhappy with the way additional advocate general Ponnavolu Sudhakar Reddy spoke in an objectionable tone in front of the High Court a few days back. With respect to Ms. Sawhney, the High Court started highlighting how she had deliberately overlooked and made the Supreme Court order lifeless and redundant.

Petitioner Regu Mahesh was contending that Ms. Sawhney had enjoyed a position of profit in her capacity as CM’s Advisor prior to becoming the State Election Commissioner. This was against the rules and hence her appointment should be withdrawn.

SEC challenges HC stay on parishad polls

It is back to square one. State Election Commissioner Nilam Sawhney has challenged the latest High Court stay order on the ZPTC, MPTC elections. She moved a house motion for immediate relief so that the elections can be continued as per the schedule from tomorrow. She filed the fresh petition in the division bench of High Court after its single judge bench issued the stay order.

Nilam’s fresh petition will come up for hearing today. CM Jagan Reddy’s Advisor Sajjala Ramakrishna Reddy has also said that the SEC should approach the division bench. The parishad polls should be completed as early as possible. This only would help speed up the Coronavirus vaccination process in the State.

Sajjala has been repeatedly making allegations that the TDP is deliberately filing the court cases just to create hurdles in the election process. Because of this, the Government is facing difficulties to effectively take forward the vaccination. The TDP is acting against the interests of the public at such a critical time.

Analysts say that the SEC fresh petition is nothing unexpected. It is in accordance with the Jagan regime’s routine to first file petitions before the single judge bench and then before the division bench of the High Court. If there is no favourable order there, they go to the Supreme Court. Litigation seems to be an effective tool for CM Jagan Reddy to get things done his way.

High Court tells Nilam to file counter on polls

In a big hurry, new State Election Commissioner Nilam Sawhney issued election notification on the first day of her taking charge yesterday. In the same hurry, the BJP leaders have filed a house petition before the High Court of Andhra Pradesh, seeking dismissal of the Nilam poll notification. The court took up immediate hearing and asked Nilam Sawhney to file the SEC counter on the issue by tomorrow.

The High Court has also heard the petitions filed by three other candidates. They sought a fresh notification so that they would be able to file their nominations. The court took due note of this. As such, Nilam Sawhney would now have to file her counter in the court by tomorrow.

The petitioners have also told the court how Nilam Sawhney has issued the notification without holding the all-party meeting as per the election process. It was after issuing the notification, she held the all party meet.

Obviously, in her counter, Sawhney would repeat the same story that she has been saying in the past two days. It is that there is no point in starting the elections afresh since the process had already begun in March last year. The same nodal officers would continue this time also. Since this is the first case since she became the SEC, all eyes are on the High Court order tomorrow.

Jagan gimmick to make Nilam Sawhney new SEC

There seems to be the same old disqualification tactic employed by the ruling YCP leaders in the selection of the new State Election Commissioner. As per the guidelines, the YCP Government sent a list of three names to Governor Biswabhushan Harichandan for finalising the new SEC. The list contained the names of retired IAS officers Samuel and Premchandra Reddy in addition to Nilam Sawhney.

However, Sawhney’s name was finally approved citing reasons of disqualification of the remaining two enlisted retired officers. The rules say that the retired IAS officers who crossed 65 years of age cannot be permitted to become the Election Commissioners.

It was found out that both Samuel and Premchandra Reddy have crossed the age limit. Hence, their candidature for the SEC post became untenable. Now questions are being raised whether the Government did not check the ineligibility of Samuel and Premchandra Reddy before putting their names on the list that was sent to the Governor.

Doubts are there whether the Government deliberately made Nilam Sawhney the new SEC in order to take its sweet revenge against the outgoing SEC Ramesh Kumar. It was Nilam who defied Ramesh Kumar’s orders and eventually facing contempt of court cases.

High Court summons Nilam and Dwivedi for contempt

The High Court of Andhra Pradesh has ordered former Chief Secretary Nilam Sawhney and Panchayat Raj Principal Secretary Gopalakrishna Dwivedi to appear before the court on January 22. The court issued these orders in a contempt of court proceeding initiated by State Election Commissioner N Ramesh Kumar.

Ramesh Kumar filed the contempt case after the former CS and the PS did not carry out his orders regarding the election process. The SEC lawyer told the court that there were prior court orders but the senior officials did not cooperate with the Election Commission. They did not carry out the orders given by the SEC in order to ensure a free and fair election.

As of now, Nilam Sawhney has retired and rejoined the Government as its advisor. Whereas, Gopalakrishna Dwivedi has been continuing in his key role. It was during the Sawney time that an all out ego battle started between the Chief Minister Jaganmohan Reddy and SEC Ramesh Kumar.

The CM made caste based comments against Ramesh for just postponing the local body elections in the midst of Coronavirus epidemic last year. At that time, Jagan was in a hurry to win 90 percent local bodies and then shift the Capital City.

After the postponement, the elections were still being continued and the Capital city issue also got stuck in the courts.

Nilam Sawhney retiring, to return as Chief Advisor

One more Advisor is being added to the top team of Chief Minister YS Jaganmohan Reddy. This time, it is Nilam Sawhney, who is retiring as Chief Secretary December 31. From the next day, she will return as Chief Advisor. In her place, as expected, Adityanath Das is taking over as Chief Secretary.

YSR family loyalist and senior IAS officer Y. Sri Lakshmi will be taking over as the secretary of the municipal administration department. Only recently, she has been transferred from the Telangana cadre to the AP cadre. It is well known that Sri Lakshmi has even gone to jail once in the Jagan Reddy’s illegal assets cases.

Nilam Sawhney is being highly rewarded for her unfailing cooperation with the Government through all the court cases and controversial decisions. Especially, her cooperation became greatly necessary for CM Jagan Reddy considering the bitter experience with LV Subrahmanyam.

Already, Jagan’s team has become top-heavy with tens of Advisors from Sajjala Ramakrishna Reddy to Ajay Kallam Reddy. Now, Nilam Sawhney is being added in a higher position as Chief Advisor.

AP govt seeks Rs 840 crore immediate flood relief

An inter-ministerial team from the Centre on Monday met Andhra Pradesh chief secretary Nilam Sawhney to discuss the damage caused by the recent torrential rains and flash floods that hit the state.

The central team held a meeting with the Chief Secretary at the Secretariat. The state administration, across all major departments, presented a photo exhibition before the central team to show the extent of damage caused to the crops and loss to property due to the floods. 

The Chief Secretary told the central team that the floods caused more than Rs 6,386 crore damage to crops and properties in the state and sought an immediate release of Rs 840 crore. Apart from agricultural and horticultural crops, the floods have caused severe damage to fisheries, animal husbandary, sericulture, roads and other state infratructre. The Roads and Buildings department incurred a loss of Rs 2,976 crore, the CS told the visiting central team.

During the visit, the central team assessed the situation in the rain and flood affected areas in Guntur. The team was represented by officials from agriculture, finance, department of Water Resources, Power, Road Transport and Highways and Rural Development. The Central team had toured the flood-affected agriculture and horticulture fields in Kolluru and Bhattiprolu mandals of Guntur district.

Earlier in the day, district collector A. Md. Imtiaz gave a detailed presentation on the crop loss in Guntur district with a power-point presentation, photo exhibition. He told the central team that roads and power installations suffered severe damage, while standing crops in thousands of acres were destroyed.

The district collector has apprised the central team of the extent of crop damaged. He told the officials that crops were damaged in 17,000 hectares of crop was damaged in agricultural fields, while 8,000 hectares of horticultural crops were affected.  The district collector submitted a detailed report on crop damage to the Central team.

The central team visit comes in the wake of Chief Minister Jagan Mohan Reddy’s letter to Union Home Minister Amit Shah requesting that a team be sent to the state to enumerate the losses caused by torrential rains and floods. The Chief Minister had sought Rs 2,250 crore as immediate flood relief. As per preliminary estimates, the state suffered damage to the tune of Rs 4,450 crore due to the deluge from October 9 to 13 and the consequent flooding.

Modi govt green signal, Nilam Sawhney gets three month extension

The Modi government on Wednesday gave a green signal to the Jagan government to extend the term of Chief Secretary Nilam Sawhney tenure for a period of three months from July 1 to September 30.

The central government’s approval comes after Andhra Pradesh Chief Minister Jagan Mohan Reddy’s letter to Prime Minister Narendra Modi seeking extension of Nilam Sawhney’s tenure for a period of six months. Nilam Sawhney took charge as the Chief Secretary to the Government of Andhra Pradesh on November 13, 2019, and will retire on June 30 this year. Jagan wrote a letter to Modi seeking her extension as her services are required in Andhra Pradesh in view of Covid-19 pandemic.

Sawhney belongs to the 1984 batch of the IAS and from AP Cadre. She is the first woman CS in bifurcated Andhra Pradesh. She is also, perhaps, the only Chief Secretary in the country to receive contempt notices from the High Court for not complying with the court’s order to remove the blue, green and white colours (YSRCP coloours) from Gram Panchayat buildings. In what was regarded as a blot in her blemishless track record, Nilam Sawhney had to cut a sorry face in the High Court in the removal of YSRCP colours case.

Chief Secretary assures immediate relief to victims

AP Chief Secretary Nilam Sawhney, who has been camping in Vizag, has said that compensation will be paid to the victims of toxic gas leakage soon. Necessary steps are being taken to provide Rs. 10,000 to each family in the surrounding affected villages. She said that over 450 injured persons came for treatment at the hospitals. The administration has provided food and shelter facilities to over 10,000 residents who are forced to vacate their houses in view of the tragedy.

The CS has said that a technical committee at the district level has been looking into the leakage issue. At the same time, a state level committee has also begun probing the case. As of now, traces of gas are still present in the atmospheric air in the nearby villages of the LG Polymers factory. So, the residents of the five villages were asked not to return home for the next two days. The authorities will keep a vigil on the situation for future alerts to the aggrieved residents.

Ms. Sawhney said that the technical committee will study and give an action plan to relocate all such polluting industries from residential localities in the city. All steps will be taken to prevent recurrence of gas leak mishaps in future. No traces of Styrene gas were recorded in areas near Pendhurthi Road and Vepagunta.

Sawhney stuck in a constitutional crisis of her own making?

All opposition parties are taking strong objection to AP Chief Secretary’s letter asking State Election Commissioner N Ramesh Kumar to re-start election process as there’s no corona virus threat in the state. Worst of all, Ramesh Kumar hit back strongly saying he has consulted the Central Government before making the decision. Obviously, the CS letter has triggered a major constitutional crisis.

Everybody looked at CM Jagan serious casteist statements against SEC from a political angle. But CS letter is being seen as a serious violation of the Constitution of India. Moreover, Ramesh Kumar is also a very highly connected retired IAS officer. Questions are being asked whether Sawhney will face serious repercussions. Was it irresponsible on the part of CS to play with the lives of people by downplaying seriousness of the virus situation? Strangely, the Health Secretary is keeping silent on the matter. Political analysts say that CS is getting caught in a complicated situation where she would face not just a constitutional crisis but also serious trouble for her negligence in case of a virus outbreak.
