Indian audience are getting to watch new releases on digital platforms every weekend. This time, there are a lot of releases across several digital platforms. King Khan’s Shah Rukh Khan’s Jawan is now streaming on Netflix in Hindi, Telugu and Tamil languages. Ram’s mass entertainer Skanda is available in all languages on Disney Plus Hotstar. Small Tollywood film MAD is now streaming on Netflix. The film has impressed youth bigtime. Critically acclaimed film Month of Madhu is available on Aha.

Tamil movies Irugapatru, Are You Ok Baby, Raththam and Thamizh Kudimagan are now streaming this weekend. The remastered version of SS Rajamouli and Ram Charan’s Magadheera is now available on Aha. Sly, Nyad, Blue Eye Samurai, Ferry, Daily Dose of Sunshine, Invincible are the international releases.

OTT Releases: Tollywood producers lack Unity

A bunch of big-budget Tollywood films headed for OTT release in three weeks after the theatrical release. There was a debate about the OTT deals killing the theatrical market. Tollywood producers several times announced that Telugu films should have a digital release only after 56 days of the theatrical release but it was never followed. A bunch of top producers met a couple of times in the recent weeks to discuss about the issue. Some of them wanted to impose a strict deadline for the digital release of any Telugu film.

But most of them did not agree for a strict cap for OTT release. Some of the producers cited that the heaping up budgets and the remunerations of stars made them to choose early OTT deals. There is no unity among the producers and they did not agree for the deals. For now, every producer is traveling in his own path when it comes to the OTT deals. We have to wait to see if the future talks end up positive so that there would be no threat to theatrical business in the future.

SC: New OTT rules lack teeth, no mechanism to screen content

The Supreme Court said on Friday that the government’s new rules for OTT platforms have “no teeth, as there is no provision for the prosecution of those who do not abide by these rules”.

A bench headed by Justice Ashok Bhushan said: “These rules are only guidelines… no mechanism to control (the content on OTT platforms). Without legislation, one cannot control it.”

The observation was made by the top court during the anticipatory bail plea hearing of Amazon Prime Video India head Aparna Purohit against an Allahabad High Court order, which declined to entertain her anticipatory bail plea in connection with the FIRs lodged against her over the web series ‘Tandav’.

The top court observed that “uncontrolled and unscreened” viewing of films on OTT platforms is an issue. “One of the issues, which has cropped up in the facts of the present case, is regarding control and regulation of the platforms on which web series are released,” noted the bench also comprising Justice R. Subhash Reddy.

Senior advocate Mukul Rohatgi, appearing for Purohit, submitted that the government had issued a notification on February 25, 2021, introducing the rules, namely The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

“A perusal of the rules indicate that they are more and more in the form of guidelines and have no effective mechanism for either screening or taking appropriate action against those who violate the guidelines,” the top court said after examining the new rules.

Solicitor General Tushar Mehta, appearing for the Centre, submitted that the government shall consider and take appropriate steps for regulation or legislation as may be found fit by it and the same shall be placed before the top court. Mehta asked for two weeks’ time to submit a response in the matter.

Rohatgi submitted that with regard to the FIR lodged in Lucknow, Purohit is cooperating with the investigation and the high court has already granted protection to the petitioner.

He added that his client is ready to cooperate with the investigation into another FIR. He clarified that his client is not involved with the production, writing or direction of the web series and is merely an officer of the company which owns the platform on which the web series was released.

In the backdrop of the top court’s observation on Thursday on pornographic content on OTT platforms, Rohatgi said the observation has been widely reported by the media.

“There is no such thing on Amazon Prime and Netflix. I see them every evening. There is no such content,” submitted Rohatgi.

Mehta replied that the bench meant pornographic content. To which, Rohatgi said: “I see so many shows. There is no pornographic content.”

The bench also granted protection from arrest to Purohit, who had moved the top court apprehending arrest.

“We direct that the petitioner shall not be arrested subject to her cooperation with the investigation. She shall appear before the investigating officer as and when required,” the top court said in its order.

Digital platforms taking new paths

The coronavirus pandemic left an unforgettable mark on the film industry. The film industry is the most impacted and it will take years for them to recover. Zee5 acquired the copyrights of Sai Dharam Tej’s Solo Brathuke So Better for a decent price and they are releasing the film in theatres. They even acquired the rights of Sai Dharam Tej’s upcoming movie Republic directed by Deva Katta for a fancy price.

The producers are making decent profits out of these deals and they would have zero risk. Several OTT platforms are in plans to acquire the rights of upcoming Telugu films featuring young heroes and close the deals. The producers would be in a safe space and their films will head for theatrical and digital release too. The OTTs too will mint money as they would sell off the other rights. Several filmmakers are holding talks to close the deals. In the future, there would be several similar deals and the OTTs, corporate firms are expected to change the style of business for Telugu cinema.

Digital deals: A Challenge for Tollywood Filmmakers

After the theatres are shut because of the coronavirus pandemic, the OTT platforms offered staggering deals and released several films of stars on their digital platforms. The digital platforms have changed plans and are strict with their new stands. They are completely against acquiring the streaming rights of small budget films and those that do not feature stars. Amazon and Netflix have been paying the amounts in three installments for the filmmakers.

Some of them delayed the process of paying and the dates of the deals are finalized by the digital platforms. These OTT players are also against closing the deals and they are offering payments through pay per view process. They are also not ready to close the deal without watching the movies. With several new rules imposed, the Tollywood filmmakers are finding it tough to close the digital deals of their upcoming movies. The single screens across Telugu states are expected to resume their operations from next weekend.

Samantha’s celebrity talk show for Aha

Telugu OTT platform Aha inked a deal with top Telugu actress Samantha Akkineni for a celebrity talk show which will stream on Aha very soon. The shoot of the show is currently happening in Hyderabad. Samantha already started shooting for the talk show and completed the episodes with Allu Arjun, Vijay Devarakonda, Naga Chaitanya and Tamannaah. Some top Tollywood celebrities will make their presence on Samantha’s show in the coming weeks.

The show starts from Diwali on Aha. The actress recently surprised the small screen audience with her hosting skills for a couple of episodes of Bigg Boss 4 recently. Samantha will sure live up the expectations with her talk show expressed netizens on social media. The actress will start the shoot of her next film in 2021.

OTT platforms coming up with new deals

With the theatres closed and peopled locked in their homes because of the coronavirus, the OTT platforms gained enough number of subscribers and generated high revenue. Most of the Telugu movies that had a direct digital release failed to live up the expectations. The OTT platforms shelled out lots of money and acquired the digital rights of the movies. But they are keen to come up with new deals. The digital platforms are in plans to close the new deals on 50-50 ratio basis.

They will pay half of the amount as advance and the rest half of the amount would be paid after days after the film’s streaming. Some of the digital giants are in plans to buy the rights only after watching the film in a private screening. OTT platforms are in plans to introduce minimum guarantee system. Some of the deals depend on the views the film received. It is like a pay per view basis. The price will also change depending on the viewership of the product. This would benefit both the producer and the digital platform if the film impresses the audience. The plans and deals of the digital platforms are slowly changing now.

Digital deals: What about theatrical release?

Several Bollywood makers inked interesting deals with the digital giants allowing a digital release for their films skipping the theatrical release. Some of the Bollywood exhibitors and multiplex chains responded saying that this is not a healthy move from the producers. Tollywood producers are now heading for digital release for their films after they came to know that the theatres will not reopen anytime soon. The Tollywood distributors and exhibitors are not much bothered about the digital releases as they are well aware of the reality and current situations.

As per the update, the digital platforms are not much interested to have a full run theatrical release for all these films. They are said to have allowed the producers for a week’s theatrical release after the theatres open doors. The digital platforms are shelling out huge amounts for the digital rights and they have certain contracts that are asked to be signed by the producers. With the digital streaming rights sold for record prices, the producers too are not much worried about the rules and guidelines.

Nani’s V is the first film to have a digital release from Telugu cinema and it will start streaming from September 5th.
