5

Days after her 21-year-old daughter Divya Tejaswini was killed by her alleged husband Budigi Nagendra Babu alias Chinna Swamy, her parents met Chief Minister Y S Jagan Mohan Reddy. The Chief Minister announced Rs 10 lakh compensation to Divya’s parents.

Home Minister Mekhathoti Sucharita, who arranged for a meeting of Divya Tejaswin’s parents with Jagan at his camp office at Tadepalli, said the accused Nagendra Babu would be arrested once he recovers. Further, the Home Minister said the accused will be tried under Disha Act. Chargesheet will be filed within a week. Divya’s parents briefed the Chief Minister about the injustice done to her daughter and the entire family. The Chief Minister assured speedy justice to Divya’s parents.

Divya Tejaswini, an engineering student, was allegedly murdered by slitting her throat. The accused Nagendra Babu later inflicted knife wounds on himself and is currently undergoing treatment at the Government General Hospital in Guntur. Swamy, a painter, was reportedly known to the victim and her family and was allegedly harassing the 20-year-old. His family, however, alleged that that two had secretly married.

Such a failed CM not seen before in State’s history, says Naidu

8

Former Chief Minister N Chandrababu Naidu has asserted that the YSRCP Government threw up its hands in helplessness when the farmers and poor families were suffering the worst in the heavy rains and floods. The Chief Ministers, Ministers and the ruling party MLAs of turning their backs on the flood-hit families in the affected areas. CM Jagan Reddy was just making a few rounds in the name of aerial surveys but doing nothing to help the needy.

Naidu said the YCP regime was an all-round failure and that the Government abdicated its responsibility in Coronavirus preventive measures, flood water management, relief extension and assistance to farmers and artisans. Such a failed CM was not seen before in the State’s history. Good people would suffer the most under the rule of ruthless leaders. The security of Dalits, Tribals and Muslim Minorities had become a big question mark in the State. Never before, this kind of atrocities took place on the weaker sections.

The TDP chief said that wherever they go, the YCP Ministers were being confronted by the people for lack of support. The Government was watching the situation like a helpless spectator. It was washing its hands of the victims by giving just Rs. 500. It was atrocious to say that essential commodities would be given only when a house would be submerged for a week.

Mr. Naidu asserted that had the TDP come to power, Polavaram project would have been completed by now. Another 10 to 15 projects would have been completed. If the YCP Government did not cancel works, Polavaram would have come into use for the farmers by now. It would have helped to ensure water supply to the backward Rayalseema districts and drought-hit areas. The TDP should create awareness among the people on this aspect.

Jagan referendum to root out corruption in sand mining

2

Finally, CM Jaganmohan Reddy has fulfilled the Opposition’s demand for removing problems in sand mining and supply but in his own inimitable style. He has ordered a referendum to take public opinion on sand policy and implementation. Rivals demand for making sand available at affordable rates was not immediately conceded. What more, CM Jagan has asked officials to prepare a new sand policy based on this public opinion.

After 17 months of his rule, Jagan Reddy has decided to reform sand mining and transportation. The objective was to root out corruption and prevent illegal mining and transportation.

It is well known how the YCP Government’s sand policy till now has triggered massive protests all over. The TDP, Jana Sena, the BJP and all rivals have criticised the CM, Ministers and MLAs for exploitation. There were allegations of illegal transportation of AP sand to metro cities in surrounding states. As a result, sand shortage in AP has caused collapse of the construction sector leading to loss of work opportunities for construction workers and their suicides.

The Opposition leaders are asking why CM Jagan was wasting time in the name of forming another policy instead of plugging loopholes in the existing system.

Referendum is just another gimmick to mislead people and exploit sand further. If he is truthful enough, he should opt for referendum on his U-turns on AP Capital and Dalit welfare.

Jagan assures compensation to rain-hit people

3

Chief Minister Jagan Mohan Reddy on Monday reassured financial compensation to the people hit by flash floods after heavy rains battered the state.

“The state government will provide compensation to the victims of heavy rains and flash floods in the state,” Jagan said. The Chief Minister conducted an aerial survey of flood-hit regions in Andhra Pradesh, especially Guntur and Krishna districts and took stock of the grim situation in the state after heavy rains and flooding wreaked havoc in the affected districts, disrupting normal life and causing damage to crops.

Standing crops and roads were damaged and the transportation system was hit in the state. At least, 15 people were killed in rain-related incidents. Due to the continuous rains, rivers, streams and canals are in spate. The floods caused severe damage to roads, power and infrastructure.

The CM was accompanied by ministers Mekapati Sucharita, Kodali Nani. The high-level ministerial team visited Nandigam, Avanigadda, Penumaluru, Mylavaram, Tadikonda among others and assessed the damage to crops. Farmers incurred a heavy loss due to crop damage during the harvesting time.

After conducting an aerial survey, Jagan at a review meeting directed the officials concerned to pay compensation to the families of those who died and those who lost their homes in the heavy rainfall. He directed the officials to fast track the compensation process and also asked them to provide input subsidy to farmers.

Heavy rains lashed parts of Vizianagaram, Prakasam, Nellore, Krishna, Guntur , West Godavari and East Godavari districts. The Chief Minister had recently sought an immediate flood relief of Rs 1,000 crore to the State. In a letter to Union Home Minister Amit Shah, Jagan had stated that the torrential rains and floods caused a huge loss and urged him to send a Central team to Andhra Pradesh to enumerate the loss.

Jagan moots ‘token and challan system’ for sand supply

2

Chief Minister Y S Jagan Mohan Reddy on Monday held a review meeting with top officials at his Tadepalli camp office on the sand policy and directed them to maintain transparency in the policy.

The Chief Minister directed the officials concerned to improve efficiency in sand supply and quality of sand. Jagan urged the officials to bridge the gap between the supply and demand of sand in the State. Further, the Chief Minister also directed the officials to ensure that the sand is supplied on subsidized prices to the poor for the construction of houses.

“Building up the capacity can attract large companies or even the central government institutions,” he suggested. During a review meeting on New Sand Policy, Jagan also asked the officials to maintain utmost transparency in supply of sand and eliminate any scope for corruption.

“Quality sand should be supplied at affordable prices and illegal mining should be strictly curtailed. Currently, the transportation charges are very high. A single case of illegal sand mining will cause damage to the State. There should be an effective mechanism for the effective implementation of the sand policy, by ensuring transparency. We have to ensure that the transportation charges should be brought down and should be reasonable. We should introduce a challan system whereby anyone who pays challan should be allowed to transport transport. This will bridge the gap between supply and demand,” he said.

The review meeting was attended by state ministers Peddireddy Ramchandra Reddy, Perni Venkataramaiah, Kodali Venkateswara Rao and officials of the Panchayat Raj Department.

The Chief Minister also mooted a ‘token system” for supply of sand for the construction of government projects and construction of houses for the poor.

In 2019, after he swept to power, the Chief Minister had introduced a new sand policy giving full powers to state-owned AP Mineral Development Corporation Ltd to undertake sand quarrying and supply sand to the customers on behalf of the government at the stockyards set up across the state. Consumers were asked to book the sand online. It was also announced that the movement of trucks will be tracked to prevent black marketing, hoarding and artificial supply shortage.

The state government’s New Sand Policy has come under sharp criticism with opposition parties blaming the govt for pushing lakhs of workers into unemployment due to shortage of sand that has led to a slump in construction activity.

Telugu Desam Party president and former chief minister Chandrababu Naidu had often alleged that the sand scarcity was man-made as the YSRCP leaders were running a sand mafia with the patronage of Jagan Mohan Reddy.

Jagan’s Arogya Asara for Rs 134 Cr cash transfer

3

Andhra Pradesh Chief Minister YS Jaganmohan Reddy is unstoppable as far as his innovative Cash Transfer programmes are concerned. The CM has introduced lots of programmes in the spirit of his Navaratnalu promises to deposit hard cash directly into the bank accounts of the poor beneficiaries. The latest cash transfer is Arogya Asara. Under this, the Government has identified over 2.10 lakh persons for transfering Rs. 5,000 each into their bank accounts.

Over Rs. 134 Cr would be transferred to these beneficiaries within the next 49 hours. The YCP says that this latest programme is introduced to help the elders of poor families to recover fast after treatment in hospitals.

YCP MP Vijay Sai Reddy says that after YSR, it is only Jagan Reddy who is implementing many programmes courageously to help the people. Even the Rayalaseema irrigation projects are getting good attention under the YCP regime.

Vijay Sai Reddy said that thanks to copious rains, the parched lands are seeing greenery once again and Seema lands are looking like Konaseema lush green fields. This is why Jaganmohan Reddy’s rule is called a ‘farmers’ regime’.

The YCP cadres are confident of the countless cash transfer schemes in their bid to protect old vote banks and also create new support groups. The partymen bank heavily on these programmes to stay in power for the next 30 years.

56 BC Corporations formed: Jagan vote bank politics

1

The Opposition is badly criticising the YCP Government for not giving funds to the BC welfare corporation to implement self-employment schemes. It is a mere waste of time to form separate corporations for different castes. Giving least care, the Jagan Reddy regime has gone ahead and announced a long list of Chairmen and Directors for corporations for over 56 backward classes castes.

Several Ministers have announced these lists with much fanfare at the Tadepalli residence of Chief Minister YS Jaganmohan Reddy. As told before, corporations were formed for 56 out of the total 139 castes of BCs. Each corporation has got 12 Directors along with a Chairman.

Special care was taken to allot 50 per cent of these posts to women. Deputy Chief Minister Dharmana Krishna Das, Ministers Botsa Satyanarayana, Anil Kumar Yadav and others announced these posts.

It is well known the TDP has got a dominant hold on the BC vote banks all over the State from the beginning. The BCs in the North Andhra districts were mostly in favour of the TDP. Amid this, the ruling YCP is seeing new BC corporations as a major turning point for them. But the TDP is confident that the BCs are already unhappy with the Jagan regime for weakening their welfare corporations by not giving any funds.

Justice Ramana: We can’t win people’s trust by force

Justice NV Ramana, sitting judge of the Supreme Court, has been in the eye of a political storm after CM Jagan Reddy’s letter to the Chief Justice of India. AP CM accused him of influencing the High Court of AP to deliver judgements against his Government’s policies and programmes. Amid this, Justice Ramana broke his silence and made indirect remarks on ethics and values that one must stand for in difficult times. It must be noted that one should not remember Lord Rama for all his victories against demons and anti-socials. One should remember him for how steadfastly he stood by his values while facing trials and tribulations.

Justice Ramana delivered his address online at a condolence meeting of late Justice AR Lakshmanan who served as a Judge of the Supreme Court. He recalled Justice Laksmnan’s words that the Indian judiciary including the bar and the bench together have passed on a rich legacy of commitment, efficiency and fearlessness to the country. Everyone must strive hard for protecting a strong and independent judicial system.

Justice Ramana pointed out that one cannot win credibility and people’s trust by force. We would be judged not by what we have but by what we have done and what are all its consequences. Our values are our wealth. We shall not forget this ever. We must face and overcome stress, pressures and threats with courage. Only people’s confidence would be the biggest asset of the judiciary.

Jagan’s letter exposed his criminal cases in Delhi circles

2

Has AP CM Jaganmohan Reddy’s audacious letter to the Chief Justice of India backfired on himself? Are the Supreme Court judges now wondering about so many cases pending against Jagan Reddy? Why are the national level politicians of almost all political parties blind to AP CM’s multiple serious cases till now?

No doubt, all sections of Delhi society including advocates’ associations are left stunned at the track record of CM Jagan Reddy. Till now, they have known Jagan as a young AP CM who has defeated IT-savvy and CEO-style TDP chief Chandrababu Naidu. Most top leaders of different parties and judges in Delhi only know Jagan Reddy as a giant killer who has won a massive mandate of 151 out of 175 MLAs in 2019 elections.

In the first 16 months of his rule, CM Jagan took many controversial decisions like mandatory English medium that have received setbacks in the Supreme Court and sparked national level debates. His Government in AP launched a direct confrontation with the Chief Justice of AP, which also attracted some attention in the Supreme Court and also in Delhi circles. But, still there was not much damage to Jagan Reddy’s general profile in the eyes of intellectuals and thought leaders in Delhi’s prime circles. Things changed overnight now. All of them are now discussing the huge number of cases involving AP CM and his illegal assets cases investigated by the CBI and the ED.

With just one letter, Jagan Reddy has fallen into the ditch he has dug up himself, says ABN Radha Krishna. In his Weekend column, he says that AP CM made this one costly mistake thanks to the jealousy and greed of former judge Justice Jasti Chalameswar. Ironically, Justice Chalameswar is a Kamma by caste and once worked for the TDP. He bore a grudge against both Justice NV Ramana and Chandrababu Naidu, which was why he became a party to Jagan Reddy’s latest gameplan to prevent Justice Ramana from becoming the next CJI.

The Bar Association called the letter against Justice N V Ramana, who is next in line to be CJI, an attempt to overawe the judiciary and and amounts to contempt of court.

“The Delhi High Court Bar Association condemns this blatant attempt to shake the confidence of the public at large in the judicial institution which has been performing its duty of due administration of justice assigned to it by the Constitution of India,” reads the resolution passed by Delhi High Court Bar Association had stated last week.

Abhijat, in a letter to Delhi Police Commissioner, lodged a complaint stating that he has been receiving threat calls from some unknown numbers and appealed to the police boss to investigate the matter.

In the letter, Abhijat requested the police to thoroughly probe and take necessary action against the people who were making such calls in order to intimidate him. He stated that he was receiving calls with some unidentified people threatening to kill him.

Jagan, in an October 6 letter to Chief Justice of India S A Bodbe, had alleged that Justice Ramana “has been influencing the sittings of the (Andhra Pradesh) High Court including the roster of few Honourable Judges”. The letter, which was released by Jagan’s office on October 10, also referred to Justice Ramana’s alleged “proximity” to TDP chief N Chandrababu Naidu, and the Anti-Corruption Bureau investigation into “questionable transactions of land” involving Justice Ramana’s two daughters and others in Amaravati, before it was declared the site for the new capital of the state.

Last week, the Delhi High Court Bar Association, in a unanimous resolution, said that the letter and its circulation in public domain is “a dishonest attempt at overawing the judiciary” and termed Justice Ramana, who is next in line to be the Chief Justice of India, as “one of the most virtuous judges with the highest level of integrity”.

Jagan’s letter dangerous threat to judiciary: Supreme Court Bar Association

1

The Supreme Court Bar Association on Saturday strongly condemned Chief Minister Jagan Mohan Reddy’s letter alleging impropriety by Justice N V Ramana, a sitting judge of the Supreme Court and next in line to be Chief Justice.

The Supreme Court Bar Association in a resolution has stated that Jagan’s letter will severely undermine public faith in the independence of the judiciary.

Jagan in his letter alleged a “nexus” between senior Supreme Court judge Justice N V Ramana and former chief minister N Chandrababu Naidu and judges of the Andhra Pradesh High Court. In a letter (dated October 6, 2020) to Chief Justice S A Bobde, Jagan alleged that N V Ramana “has been influencing the sittings of the high court including the roster of a few Honourable Judges” in connection with Naidu’s Telugu Desam Party.

The Supreme Court Bar Association stated that a sitting chief minister of a state making such baseless allegations is a cause for serious concern and that such scandalous and unsubstantiate, allegations could herald a dangerous threat to the judiciary. Further, it stated the Chief Minister’s attitude towards judges is a serious risk that could have a prejudicial effect on the image of the higher judiciary. In a letter to the Chief Justice, the association further stated that there is an urgent need to preserve the faith of the people in the independence and impartiality of the judicial process.

“The allegations made by the Chief Minister are violative of the concept of criminal contempt. The CM’s letter is an interference with the due course of a judicial proceeding by attempting to influence the appeals filed by the AP government in the Supreme Court against the HC orders. It is an attempt to interfere and obstruct the administration of justice by ascribing motives to judges and decisions of the court that went against the government,” the SC Bar Association stated. The association was of the view that the Supreme Court should initiate contempt proceedings against Jagan Mohan Reddy and leaders from the YSRCP government.

Jagan had alleged bias in decisions of the Andhra Pradesh High Court in favour of the TDP, including the stay orders on investigation of the FIRs into purchase of land in Amaravati and the High Court gag order.

Earlier, the Delhi High Court Bar Association took serious objection to Jagan’s letter lowering the dignity of Supreme Court Justice N V Ramana by casting aspersions, two Supreme Court lawyers filed a petition in the top court with an appeal to remove Jagan as Chief Minister of Andhra Pradesh. The two petitioners – G S Mani & Pradeep Kumar Yadav – contended in their plea that Jagan who is facing over 30 criminal cases has been abusing his power and post as the Chief Minister of Andhra Pradesh.

The Bar Council of India last week wrote to SC Chief Justice S A Bobde stating Jagan’s letter was a deliberate attempt to demean judges, the entire legal fraternity and the Constitution of India itself.

Bar Council of India chairman Manan Kumar Mishra stated that the contents in Jagan’s letter and the serious allegations leveled against Justice N V Ramana have to be viewed seriously and necessary action should be initiated. He stated that Jagan’s letter is a blatant attempt to shake the confidence of the public in the judiciary.

Noushad Ali, a former Andhra Pradesh High Court judge, also wrote a letter to Chief Justice Bobde stating that Jagan’s letter smacks of “orchestrated allegations” against Justice N V Ramana. In the letter, Noushad Ali stated, “Their projection is that their leader is a unique person having a mandate of 151 MLAs out of 175 strength, hence the courts should respect him as superior. “In his letter, the Chief Minister made charges against orders passed by the Andhra Pradesh High Court in recent months, all of which are pending before the Supreme Court. On Wednesday, Supreme Court advocate Ashwini Kumar Upadhyay, on whose petition Justice Ramana’s bench had ordered speedy trial of cases against politicians, also wrote to the CJI asking for a “full court meeting” to discuss the issue.

Supreme Court advocate Ashwini Kumar Upadhyay, on whose petition Justice Ramana’s bench had ordered speedy trial of cases against politicians, also wrote to the CJI asking for a “full court meeting” to discuss the issue. “The letter was released in public domain not only to derail the Election Reform matters but also to intimidate judicial proceedings,” Ashwini Kumar has pointed out in his letter to Chief Justice Bobde. Ashwini Kumar Upadhyay stated that Jagan’s letter and subsequent press conference “is more than dishonest mischievous attempt to pressurize the judiciary.

The Supreme Court Women Lawyers Association too expressed its disappointment over Jagan letter. “Such a precipitous and irresponsible act is highly improper. It undermines the dignity of the institution and shakes the confidence of people at large,” the statement said.

Entire Cabinet responsible for Jagan’s letter

5

The Andhra Pradesh High Court Sadhana Samithi Committee took strong objection to Chief Minister Jagan Mohan Reddy’s letter to Supreme Court Chief Justice S A Bobde alleging that sitting judicial impropriety against Supreme Court judge Justice N V Ramana and a number of judges of the Andhra Pradesh high court.

Andhra Pradesh High Court Sadhana Samithi Committee convener D N.V. Prasad Babu stated that Jagan had written the letter on the advice of Advocate General Sriram. “In the letter, Jagan had clearly mentioned that he has taken proper legal advice. Sriram has no moral right to continue as Advocate General and should immediately resign from the post ,” Prasad Babu said.

Further, Prasad Babu was of the view that the central government was in full knowledge of Jagan’s letter. “The Chief Minister has written the letter after his Delhi visit. The legal fraternity is of the view that Jagan has consulted the central government and accordingly has written a letter to Supreme Chief justice Bobde alleging impropriety against Supreme Court judge Justice N V Ramana and a number of judges of the Andhra Pradesh high court. If the chief minister has not consulted the central government before writing the letter, then the union government should take necessary action. Any decision taken by the Chief Minister is deemed as a decision taken by the entire Cabinet. Therefore, all the ministers will automatically be held responsible for the chief minister’s decisions,” Prasad Babu said

Gadkari, Jagan inaugurate Kanaka Durga flyover

7

The 2.3-km long Kanaka Durga Temple flyover will be thrown open to public use from today. Union Minister Nitin Gadkari and AP Chief Minister YS Jaganmohan Reddy will inaugurate the historic flyover online. The inauguration is scheduled now a day ahead of the start of the Durga Navaratri Utsavams at the temple. As is well known, the flyover has been a long-standing dream of the people of Vijayawada considering its vital importance in solving the frequent traffic congestion in the National Highway passing adjacent the hill temple.

The Durga flyover now curves around the Indrakeeladri hill atop which is located the Kanaka Durga Temple. This is expected to ease traffic jams in the temple surroundings by solving the heavy and high volume traffic from Hyderabad entering into Vijayawada and moving towards Chennai and vice versa. The flyover is built with advanced technology and has got a four lane road to meet the needs of highway traffic.

The flyover starts from Bhavanipuram flies alongside the Krishna river, Kanaka Durga Hill Temple and over the Buckingham canal to land on the highway near Pandit Nehru Bus Station near the Prakasam barrage. Rival political parties claim credit for completing the flyover in accordance with the wishes of the local people. The project was begun in 2010 but real progress in works began in 2015. For various reasons, there was inordinate delay. Finally, the historic flyover is now being made available for public use.

The leaders of Telugu Desam Party claim that 70 per cent works were completed in its previous regime. The YCP leaders say that their party has successfully completed what the previous rule could not do. Whereas, the BJP leaders asserted that their party’s Central Government has provided funds and ensured completion of the project.

Pained at Jagan’s letter, former HC judge writes letter to CJI

0

After BJP leader and Supreme Court lawyer Ashwini Kumar Upadhyay former judge of the Andhra Pradesh High Court, Justice Noushad Ali has written a letter to Chief Justice of India S A Bobde terming the allegations made by Chief Minister Jagan Mohan Reddy against sitting Supreme Court judge N V Ramana as an interference with the administration of justice.

Noushad Ali, in his letter to Justice Bobde, pointed out that Jagan’s allegations were solely intended at influencing the minds of the trial court judges before whom cases against the Chief Minister were pending. The former Andhra Pradesh HC judge stated that he was deeply pained at the way the judiciary is being “denigrated by the political and executive establishment” in Andhra Pradesh.

The judge takes particular exception to this statement in the Chief Minister’s letter:

“Each one of the three branches of governance are designed as checks against the other for balancing the great powers endowed by the constitution.”

The letter clearly suggests that CM can put the judiciary or Parliament in check. I am afraid whether such is the position in the Constitution. In my opinion the chief minister is clearly under an illusion. In my humble opinion, petitioning for the administrative interference of the Hon’ble Chief Justice, when the court is seized of the matter on its judicial jurisdiction amounts to direct interference with the administration of justice.””

“The High Court of Andhra Pradesh has been under constant attack almost on a daily basis. Shockingly, the High Court is under attack from Assembly Speaker, minister, legislators of the YSRCP and advisor to the government Sajjala Ramakrishna Reddy,” Noushad Ali wrote.

“The Chief Minister made a scathing attack on Supreme Court Justice N V Ramana. He alleged that Justice Ramana has been influencing the matters of the High Court including roasters of a few judges and motives are being allotted to certain judges, alleging nexus between them. The Chief Minister also alleged that the two daughters of Justice N V Ramana, his close associates and relatives were benefited through various land transactions which are questionable,” he added.

Noushad Ali in his letter to Justice S A Bobde wrote, “First I thought that the attacks by the leaders were to gain favours with the Chief Minister, but then realized that they were orchestrated under the direction of the Chief Minister.”

Further, Noushad Ali noted that apart from the Assembly Speaker, ministers and some legislators of the YSRCP made comments on Sakshi TV channel and Sakshi newspaper, both owned by Jagan Mohan Reddy. Noushad Ali also quoted a Sakshi newspaper report (dated 11.10.2020) wherein several judges’ names were dragged into an “unwarranted controversy” under the headline “High Court orders aiming to benefit TDP.” He cited another report carried in the Sakshi newspaper (dated 20.9.2020) by Varadapalli Murali along with a cartoon.

The cartoon shows a bird with its beak tied. The article and the cartoon refer to the High Court ‘gag’ order on media suggesting that the media has been cruelly tied. The writer has alleged some nexus between former chief minister Chandrababau Naidu and a judge of the Supreme Court without mentioning his name.

In the same newspaper (dated 3.10.2020), government advisor Sajjala Ramakrishna Reddy’s comments were published. The government advisor commented that the institution under the Constitution should be self-reliant and comments made by one institution against the other would cripple that institution.

He said a series of reports were published in Sakshi newspaper and in social media in an attempt to cause irreparable damage to the reputation of the judiciary, particularly the state judiciary and several High Court judges. “Making such statements not only scandalize the courts in the eyes of the public but also amounts to direct interference in the administration of justice besides causing irreparable damage to the reputation of individual judges,” Noushad Ali stated in his letter. “In the paper (dated 20.9.2020) comments made by YSRCP MPs were published. Some of the comments were made both inside the House and outside the Parliament,” Noushad Ali noted.

Jagan in his letter to Chief Justice of India S A Bobde had alleged impropriety by Justice N V Ramana. In the letter, dated October 6, Jagan had accused Justice N V Ramana of “influencing the sittings of the (AP) High Court including the roster of a few honourable judges” and cited “instances of how matters important to Telugu Desam Party (opposition in AP) have been allocated to a few honourable judges…”. The letter complete with annexures, has also accused the state judiciary and five of its judges of “bias…towards Telugu Desam Party and its interests, in the nature of orders passed staying investigation, staying enquiry and the rest…”. Justice Ramana is likely to be the next CJI in April 2021, after Justice Bobde demits office.

Jagan’s letter was released in public domain. The contents of the letter were repeatedly read in Sakshi TV channel by none other than Ajeya Kallam, advisor to the Chief Minister. The letter is circulated in social media, and I too received a copy of it on my Whatsapp. It is not difficult to comprehend why the letter was made public even when it has been sent to the Hon’ble Chief Justice.”

“The Supreme Court has withstood such attacks in the past, more particularly with its pronouncement in the Kesavanadabharati case. The learned judges are bold to withstand such attacks’ ‘, the former Andhra Pradeshh HC judge wrote in his letter to the CJI.

Jagan’s letter mischievous attempt to pressurize judiciary: SC lawyer writes to CJI

Chief Minister Jagan Mohan Reddy’s letter alleging impropriety by Justice N V Ramana, a sitting judge of the Supreme Court and next in line to be Chief Justice, has snowballed into a major controversy. After two Supreme Court lawyers filed a petition to remove Jagan as Chief Minister of Andhra Pradesh and the Delhi High Court Bar Association unequivocally condemned the letter, BJP leader and Supreme Court lawyer Ashwini Kumar Upadhyay wrote a letter to Chief Justice S A Bobde.

In the letter, Ashwini Kumar Upadhyay stated that Jagan’s letter and subsequent press conference “is more than dishonest mischievous attempt to pressurize the judiciary.

“The letter was released in public domain not only to derail the Election Reform matters but also to intimidate judicial proceedings,” Ashwini Kumar has pointed out in his letter to Chief Justice Bobde. Further, Ashwini Kumar noted that serious cases of corruption, black money, benami property and disproportionate assets are pending against Jagan Mohan Reddy and his colleagues. “Reddy and his colleagues are facing serious charges of crime and corruption which would have landed any ordinary man in jail for at least 10 years, if sentenced concurrently, and for more than 30 years, if sentenced consecutively.”

In his letter to Chief Justice Bobde, Ashwini Kumar further pointed out that Jagan Mohan Reddy’s letter is a blatant attempt to shake the confidence of the public in the judiciary. “Reddy has crossed the line which separates judiciary and executive. The letter was released in public domain not only to derail the above matters but also to intimidate judicial proceedings. In fact, Reddy is not only indulging in bench-hunting, but also wants the Apex Court to stop hearing the cases pending against him.”

In his letter, Ashwini Kumar went hammer and tongs against Jagan Mohan Reddy. He further pointed out to Chief Justice Bobde that Jagan wrote the letter which is “silly mischievous deceitful act but a deliberate fraudulent and calculated attempt to not only undermine the Apex Court but also to terrorise the judiciary.”

Ashwini Kumar appealed to Chief Justice Bobde to hold a meeting with the 9 judges “full court meeting” to discuss the issue and take appropriate stern steps in order to send a strong message “so that no one can even think of using such deceitful and fraudulent tactics against the judiciary in future.

On Wednesday, Supreme Court lawyers G S Mani & Pradeep Kumar Yadav filed a petition in the top court appealing to remove Jagan as the chief minister of Andhra Pradesh. The Public Interest Litigation filed under Article 32 of the Constitution of India (dated 14.10.2020. vide Diary No. 22452/2020) further contended that Jagan, who is facing 31 serious criminal charges, including money laundering and quid pro quo cases, is lowering the image of the judiciary by making scandalous remarks against courts and judges. The Chief Minister of Andhra Pradesh has written the letter to Chief Justice S A Bobde casting aspersions on Supreme Court judge Justice N V Raman in order to malign, tarnish and damage the senior most judge.

“The petition is filed seeking action against the 3rd respondent (Jagan Mohan Reddy) only to protect the independence and integrity of judiciary and its judges. It is painful that false, vague and political allegations were made against the senior most judge of the Supreme Court only to disturb the independence of the judiciary,” the petitioners contended.

Sajjala begins damage control on Jagan letter

7

In an unprecedented move, AP Government Advisor Sajjala Ramakrishna Reddy has sounded an urgent alert among the YCP leaders not to speak any further on the Jaganmohan Reddy letter to the Chief Justice of India. Sajjala has just put a message in the party leaders’ WhatsApp groups asking them not to issue any fresh comments on the issue. He advised the YCP leaders to just say that what needs to be said has already been clarified. This should be the standard reply to any mediaperson or anybody else who asks about the party reaction on the CM’s letter.

This damage control move initiated by Sajjala is seen as a rare panic reaction in the face of the nationwide outrage against CM Jagan’s attack on a sitting Judge of the Supreme Court of India and also against the judges of the AP High Court. It was indeed alarming that the Delhi Bar Association and also some advocates have filed complaints against AP CM. Some advocates have even appealed to the Apex Court to remove the Chief Minister for all his transgressions.

Sajjala’s message is also applicable to the YCP social media activists who are known for their malicious and aggressive campaigns against rivals and even the courts. Already, YCP social media wings are facing cases in the High Court. Usually, the YCP will not compromise in respect of launching outrageous and humiliating personal attacks against rivals and courts. But, live never before, Sajjala’s cautionary message reveals the deep soup in which the YCP has landed itself with the CM’s latest letter to the CJI.

Petition in SC to remove Jagan as CM

5

Chief Minister Y S Jagan Mohan Reddy’s letter alleging impropriety by Justice N V Ramana, a sitting judge of the Supreme Court and next in line to be Chief Justice, has landed him in a legal soup.

After the Delhi High Court Bar Association took serious objection to Jagan’s letter lowering the dignity of Supreme Court Justice N V Ramana by casting aspersions, two Supreme Court lawyers filed a petition in the top court with an appeal to remove Jagan as Chief Minister of Andhra Pradesh.

The two petitioners – G S Mani & Pradeep Kumar Yadav – contended in their plea that Jagan who is facing over 30 criminal cases has been abusing his power and post as the Chief Minister of Andhra Pradesh.

The Public Interest Litigation filed under Article 32 of the Constitution of India (dated 14.10.2020. vide Diary No. 22452/2020) further contended that Jagan, who is facing serious criminal charges, including money laundering and quid pro quo cases, is lowering the image of the judiciary by making scandalous remarks against courts and judges.

The Chief Minister of Andhra Pradesh has written the letter casting aspersions on Supreme Court judge Justice N V Raman in order to malign, tarnish and damage of the senior most judge, the petitioners contended. “The petition is filed seeking action against 3rd respondent (Jagan Mohan Reddy) only to protect the independence and integrity of judiciary and its judges. It is painful that false, vague and political allegations were made against the senior most judge of the Supreme Court only to disturb the independence of judiciary,” the petitioners contended.

Further, the petitioners argued that for the first a Chief Minister of a state has made such false allegations against a senior most Supreme Court judge. A person who is holding the post of head of the state executive should not overtake judiciary by making false allegations against the sitting judges of the Supreme Court. The general public confidence in judiciary is important. If public lose their confidence and faith in the judiciary, the very purpose is defeated, the petitioners argued. The petitioners made “proper authorities representing the government and the state itself” as the other two respondents in the case.

The petitioners, citing a newspaper report, pointed out that 31 criminal cases are pending against Jagan Mohan Reddy as per his own affidavit. The petitioners noted that cases were pending with the CBI, Enforcement Directorate and different police stations in Andhra Pradesh and Telangana.

The criminal charges include criminal conspiracy, cheating, dishonesty, criminal breach of trust, forgery, criminal misconduct, money laundering and various others. ” Thus we appeal for an appropriate action for his removal as CM of AP and also judicial enquiry constituting internal committee headed by sitting or retired judges of Supreme Court or any authority including CBI over the vague allegation made by Jagan against Justice Ramana,” the petition read.

In the letter, Jagan had suggested Justice N V Ramana had favoured former chief minister and TDP president Chandrababu Naidu and the judge’s daughters had purchased land under questionable circumstances in Amaravati before the site was chosen for the new Andhra capital. Last month, the Andhra Pradesh High Court had restrained the media from reporting about allegations of corruption in land deals in Amaravati. Coming from a CM facing a large number of cases, the allegations have to be taken with a pinch of salt.

Earlier in the day, the Delhi High Court Bar Association stated that casting aspersions on a Supreme Court sitting judge is “clearly a dishonest attempt at overawing the independence of judiciary and tantamount to contempt of the Honorable court. It is a blatant attempt to shake the confidence of the public at large in the judicial institution which has been performing its duty of due administration of justice assigned by the Constitution of India.”

In a statement, the Delhi High Court Bar Association strongly condemned Jagan for writing a letter casting aspersions on the Supreme Court judge. The Delhi High Court Bar Association stated that it unequivocally, categorically and in the strongest possible terms condemns the allegations cast upon Justice N V Ramana.

Is YSRCP govt sleeping, asks Naidu

8

Former chief minister and TDP president on Tuesday attacked the Jagan-led YSRCP government in the state for failing to meet the expectations of farmers, who had lost their land and livelihood in the floods. Naidu specifically mentioned the devastating floods in North Andhra, East and West Godavari regions.

Naidu said thousands of families are in distress in the three regions due to floods. Agricultural lands, crops and homes were damaged due the floods, but the Chief Minister has failed to take any precautionary measures to mitigate the crisis arising out of floods.

Speaking to party leaders via video conference, Naidu said the three regions have been severely hit by floods in the last two to three days. “Lives have been battered and the lives of farmers have been thrown out of gear. Farmers have incurred crores of rupees in crop loss due to the floods, but the Jagan government has miserably failed to provide relief to the farmers,” he said. He called upon the party leaders to rise to the occasion and help the farmers in distress.

“Did the people give the massive mandate as a licence to kill them? The government should focus on addressing important issues instead of attacking and foisting false cases against opposition leaders. This is the worst ever governance,” Naidu lashed out.
